In the investigation launched upon the complaint of Aleyna Kalaycıoğlu, who was arrested in connection with the murder of footballer Kubilay Kaan Kundakçı in Ümraniye, an indictment has been prepared against rapper Vahap Canbay. The indictment seeks up to 4 years in prison for Canbay on charges of 'simple threat' and 'stalking'.

Following the complaint of Aleyna Tutuş (Kalaycıoğlu), who was arrested in connection with the armed attack that killed amateur footballer Kubilay Kaan Kundakçı (21) in Ümraniye, an indictment was prepared against singer Vahap Canbay, seeking up to 4 years in prison for the crimes of "simple threat" and "stalking".

KALAYCIOĞLU SAID "I AM BEING ABUSED" AND FILED A COMPLAINT

The indictment prepared by the Istanbul Anatolian Chief Public Prosecutor's Office included a petition submitted to the case file by the complainant Tutuş's lawyer. The petition stated that the suspect, rap singer Vahap Canbay, was the former boyfriend of Aleyna Tutuş, and explained that the relationship ended due to the psychological pressure and violence the suspect Canbay inflicted on the complainant during the relationship.

The petition alleged that suspect Canbay threatened the complainant, saying he would erase her from the industry and prevent her from working again, and that despite the complainant not wanting to communicate with him, suspect Canbay harassed complainant Tutuş through various means.

The petition noted that on March 19, the suspect, along with his friends, came in a vehicle to the front of the studio where the complainant was going to work and waited.

CANBAY DENIED THE ALLEGATIONS

The indictment included the defense statement of suspect Vahap Canbay taken during the investigation.

Canbay claimed that he never said he would erase the complainant from the market, that he supported her in making her songs, and that he did not persistently follow complainant Tutuş, denying the charges against him.

The indictment stated that audio recordings submitted by the complainant's lawyer in the investigation file regarding the death of Kubilay Kaan Kundakçı on March 19 were also examined, and it was understood from these recordings that suspect Canbay, with a tearful voice, asked complainant Tutuş questions about whether she had a relationship with someone else and made statements about committing suicide.

The indictment reported that after the conversation, suspect Canbay came to the front of the studio where complainant Tutuş was working, in the vehicle used by Kubilay Kaan Kundakçı, and waited there, and around 23:00, the incident resulting in Kundakçı's death, which is being investigated separately, occurred.

The indictment emphasized that after their relationship ended, suspect Canbay made statements to the complainant such as "I will erase you from the music market, I won't let you work again, I will put copyright claims on your songs," and despite the complainant blocking him on all communication channels, he tried to contact her through third parties, committing the crimes he is charged with.

UP TO 4 YEARS IN PRISON REQUESTED

In the prepared indictment, it was requested that suspect Vahap Canbay be sentenced to 9 months to 2 years in prison for the crime of "simple threat" and 6 months to 2 years in prison for the crime of "stalking".

The indictment was sent to the Anatolian Criminal Court of First Instance for evaluation.

INDICTMENT REGARDING THE YOUNG FOOTBALLER'S DEATH

The Anatolian Chief Public Prosecutor's Office had prepared an indictment regarding the incident on March 19 in Ümraniye Tatlısu Neighborhood, where Kubilay Kaan Kundakçı, sitting in a parked car with a friend, was seriously injured after one of the defendants arriving at the scene in two vehicles opened fire with a gun, and died in the hospital where he was taken.

The indictment states that, according to the expert examination of security camera footage, two vehicles approached the car containing the deceased Kundakçı, and the suspect Alaattin Kadayıfçıoğlu, who got out of one vehicle, drew a gun from his waist, opened the front passenger door of the victim's car, and fired.

It is noted in the indictment that Kundakçı died from a single bullet causing a fatal injury, and that the suspects came to and left the area hours before the incident, creating strong suspicion that the attack was not spontaneous but planned.

Based on HTS records, mobile phone examinations, and forensic reports, the indictment emphasizes that there was intense contact between the suspects before the incident, and some contacts continued after the incident, requesting separate life sentences for the defendant Alaattin Kadayıfçıoğlu for "intentional killing" and for Aleyna Tutuş and Zuhal Kalaycıoğlu for "incitement to intentional killing".

The indictment proposes that defendants Hüseyin Can Avcı, Mustafa Rece, and Bilal Kadayıfçıoğlu be sentenced to 10 to 15 years in prison each for the crime of "aiding intentional killing", and that Metin Kadayıfçıoğlu be sentenced to 1 to 10 years in prison for the crimes of "destroying, concealing, or altering evidence of a crime" and "harboring an offender".

Additionally, the indictment seeks 6 months to 10 years in prison for defendant Engin Taşkıran for "harboring an offender" and "destroying, concealing, or altering evidence of a crime", and 6 months to 5 years each for defendants İzzet Yıldızhan and Ahmet Özkoç for "harboring an offender".
