It is not possible for me to pay compensation. I love the artist very much."

In Adana, Ali Çapar (44) shared some scenes from the film "Şalvar Davası," starring Şener Şen and Müjde Ar, on his social media account. Three months ago, due to the sharing of these scenes, a criminal complaint was filed against Ali Çapar by Müjde Ar's lawyers for violating the Intellectual and Artistic Works Law at the Adana Chief Public Prosecutor's Office. Ali Çapar was called to the police station to give his statement. Çapar stated that he shared the posts for entertainment purposes three months ago and that he was unaware it was a crime.

"I CANNOT AFFORD TO PAY ROYALTIES"

Ali Çapar stated that his posts did not have any profit motive and that he did not have the financial means to pay any potential royalty fees that might be requested. After going to give his statement to the police, he explained that he deleted all content from his social media accounts, saying, "I deleted all my posts on social media, even my own photos and videos. We were sharing these videos for fun. Müjde Ar's lawyers will request royalties from me through mediation. According to my research, the amount ranges from 50,000 to 150,000 TL. I am a worker earning minimum wage. I am a tenant and have three children. It is impossible for me to cover this amount. I really love Müjde Ar; we watch her with affection. I was very upset that something like this happened to me because of her."

"CAREFUL WITH SOCIAL MEDIA POSTS"

Lawyer Nazlı Yılmaz stated that copyright has become one of the increasing complaints recently, emphasizing that citizens need to be careful with their social media posts to prevent victimization. She noted, "Recently, it has been reported that citizens have been invited to give statements due to their posts on social media, that criminal complaints have been filed against them, and that mediation applications have been made. The content of these applications consists of video clips shared on individuals' personal social media accounts, scenes from films they liked, and songs they shared. Due to these posts, citizens are facing various sanctions. The main reason for these sanctions is the rights violated under the Intellectual and Artistic Works Law. The 25th and 71st articles of the law contain regulations on this matter. The 75th article of the law stipulates that unauthorized sharing of content such as video clips of an artist's work can result in imprisonment of 1 to 5 years. However, since there is an exception in the law for posts made from individual social media accounts, imprisonment is not applied in such cases. Nevertheless, due to the violation of copyright and intellectual rights, processes can be initiated against individuals for material and moral compensation claims. While legal proceedings regarding this issue continue, I advise citizens not to share unauthorized content to avoid harm."
