A decision has been made in the case regarding the 7-year-old child in Fatih, Istanbul, who was assaulted with a metal hanger by his stepsister and found dead in his bed the next day. The court sentenced the defendant, who said, "I didn't know the cost of this mistake would be so heavy. I wish my brother were alive so that I could have the chance to make amends," to 10 years in prison and ruled for their release.
On November 17, 2023, in Fatih, Istanbul, it was claimed that 7-year-old Servet N. was beaten by his Uzbek mother Nılufar N. and his stepsister Mehrıbonu N. (20) and was found dead in his bed the next day. The case regarding this incident has been concluded. In a recent hearing at the Istanbul Heavy Penal Court, the detained defendant stepsister Mehrıbonu N. and the non-detained defendant Nılufar N. were present. The hearing was also attended by a lawyer from the Ministry of Family and Social Services, as well as the lawyers of the defendants, and a 'representative guardian' on behalf of the deceased Servet N. The representative guardian stated during the hearing that he was complaining about the defendants on behalf of Servet N.
"FOR THE REST OF MY LIFE..."
Defendant Mehrıbonu N. expressed deep regret over the incident in her defense, stating, "The victim is my brother, and there was no animosity between us. I am living with the deep sorrow of this event. I could not have predicted that things would come to this point. I will live with this guilt for the rest of my life."
Later, the defendants were asked for their final words. Defendant Nılufar N. stated that she had nothing to say, while Mehrıbonu N. said, "I did not intentionally cause my brother's death. I am very sorry; I did not know that the consequences of this mistake would be so severe. I wish my brother were alive so that I could have a chance to make amends."
10 YEARS IN PRISON AND RELEASE ORDERED
The court announced its decision, sentencing defendant Mehrıbonu N. to 10 years in prison for 'causing death by intentional injury.' Taking into account the time the defendant spent in detention, the court decided to release her. The court acquitted defendant Nılufar N. of the same charge.
FROM THE INDICTMENT
In the indictment prepared by the Istanbul Chief Public Prosecutor's Office, it was stated that on the day of the incident, 7-year-old Servet N. was found motionless on the bed on the floor of the room, and initial checks on the child revealed injuries and bruises on visible parts of his body, and he was found dead. The indictment included the statement of Servet's stepsister Mehrıbonu N., who said that on the day of the incident, after coming out of the shower, she saw Servet approaching and hugging her 5-year-old sister Melek while wearing a t-shirt and nothing else, which made her angry, and she hit Servet on the back and legs with a metal hanger, after which her brother fainted, and she splashed water on his face to wake him up. In the continuation of the suspect's statement, she said that she gave water to her brother Servet, but he did not drink it, that white spots appeared on his face, that his color faded, and that after a while, their mother came home, to whom she explained that her brother had been beaten. It was noted that after the suspect Mehrıbonu told her mother about what happened to Servet, their mother got angry and slapped Servet a few times, and after hitting him, she tried to force Servet to eat something, but he vomited what he had eaten, and then he fell asleep, and the next day when she woke up, she saw that her brother was lying motionless in bed and thought he might have died due to past health issues.
In her statement, suspect mother Nılufar N. said that when she came home, she listened to the situation and slapped her daughter Mehrıbonu, stating that she did not beat Servet. According to the autopsy report from the Forensic Medicine Institution, it was determined that there was a link between the general bodily trauma the child had suffered and his death. The indictment stated that Servet, who was injured as a result of the actions of the suspect mother and sister, died the next day, and it could not be concretely established that the suspects had the intent to kill. The indictment requested that suspects Mehrıbonu N. and Nılufar N. be sentenced to 8 to 12 years in prison for 'causing death by intentional injury.'
