The Ministry of Interior abolished the 1980 regulation determining the functioning of the Police Organization disciplinary boards with a decision published in the Official Gazette. While the 46-year-old regulation became history, the executive authority was transferred directly to the Minister of Interior.
The Regulation on the Repeal of the Regulation on the Working Principles and Methods of the Disciplinary Boards of the Police Organization, prepared by the Ministry of Interior, was published in the Official Gazette and entered into force.
THE PROVISIONS OF THE REGULATION WILL BE IMPLEMENTED BY THE MINISTRY OF INTERIOR
With this decision, the 46-year-old regulation that had been in effect since April 5, 1980, guiding the disciplinary processes of police personnel, has become history. The provisions of the regulation will be directly implemented by the Minister of Interior.
WHAT DID THE REPEALED REGULATION INCLUDE?
The repealed regulation established the basic framework and legal boundaries for the functioning of the disciplinary mechanism within the Police Organization. The main topics covered by the regulation were as follows:
- The formation of disciplinary boards, the quorum required for meetings, and decision-making processes.
- Rules regarding situations in which members could not participate in meetings.
- The rapporteur system and procedures for conducting disciplinary investigations.
- The necessity of obtaining a defense in investigations, notification of decisions, and their implementation.
- The ability to conduct disciplinary proceedings entirely independently of criminal court proceedings.
- The duties and authorities of the High Disciplinary Board of the Ministry of Interior.
