The 60-page report on a Terror-Free Turkey was accepted in the committee with 47 votes. The AK Party, CHP, DEM Party, MHP, and New Way voted "Yes," while TİP and EMEP voted "No." One member also abstained from voting.
The draft report prepared by the commission established in the Turkish Grand National Assembly (TBMM) within the scope of the goal of a terrorism-free Turkey has been completed. TBMM President Numan Kurtulmuş evaluated the joint text as "a report that is far from creating a perception of amnesty, focusing on law and public conscience."
The completed Terrorism-Free Turkey Report consists of 7 sections:
- Commission activities
- Basic objectives of the commission
- History of Turkish-Kurdish brotherhood
- Analyses of the individuals heard by the commission
- Process of the PKK's self-dissolution
- Legal regulation proposals regarding the process
- Proposals related to democratization
NOTABLE PROPOSALS
Concrete proposals in the commission's joint report drew attention. The text emphasized that the decisions of the European Court of Human Rights (ECHR) and the Constitutional Court must be fully complied with. The issue, which is discussed in the public as the "right to hope," was referenced indirectly with the statement, "The provision of justice in sentencing is necessary."
The report also included a proposal to end the long-debated trustee practice.
REPORT ACCEPTED IN THE COMMISSION
The report prepared in line with the goal of a "Terrorism-Free Turkey" was accepted by a majority vote in the commission. TBMM President Numan Kurtulmuş shared the voting result with the public.
Kurtulmuş stated, "There are 47 votes in favor, 2 votes against, and 1 member abstained," announcing that the report passed through the commission.
The stance of political parties in the commission's vote also became clear. The AK Party, MHP, CHP, DEM Party, and New Path Party voted "yes" in the vote.
CHP member Türkan Elçi abstained. TİP member Ahmet Şık and EMEP member İskender Bayhan voted "no."
WHAT DOES THE REPORT CONTAIN?
The concrete proposals in the joint report are summarized as follows.
- The most critical point in the process is that all elements of the PKK must be confirmed to have laid down their arms by the state's security units. The detection and confirmation mechanism should operate with coordination among the state's mechanisms.
- A targeted independent and temporary law is needed for the purpose. The aim should be to reintegrate those who reject weapons and violence into society. The law should consider public conscience and public morality.
- In addition to the temporary law, it should be evaluated that legal action must be taken against individuals using the provisions of the Penal and Execution Law. An amnesty perception should not be created.
- It is essential to determine policies that facilitate the healthy progress of the social integration process and allow every individual to reach a common future with equal opportunities. The development of economic and social opportunities should be among the priorities. Investments in the region should be increased and continued.
- The law should establish a mechanism to monitor the process involving organization members. It should be observed whether the process is being conducted healthily.
- Those involved in the process, including participants in commission meetings and officials, should have their activities secured by law.
- Creating a political environment where every thought that does not contain elements of crimes such as insult and threat can be expressed is a fundamental necessity.
CONSTITUTIONAL COURT AND ECHR DECISIONS
- Mechanisms demonstrating that ECHR and Constitutional Court decisions will be fully complied with should be strengthened.
RIGHT TO HOPE
- The Execution Legislation should be revised to prioritize justice in sentencing. Care should be taken to ensure that non-custodial trials are prioritized in line with the case law of the ECHR and the Constitutional Court.
- Obstacles to the full and complete exercise of fundamental rights and freedoms should be removed.
- Actions within the scope of freedom of expression should not be considered as terrorist offenses.
- Laws that restrict press freedom should be reconsidered.
- A new Political Parties Law and Election Law should be prepared.
- A Political Ethics Law should be prepared.
TRUSTEE
- In the event of the removal of a Mayor from office, elections should only be held in the Municipal Council.
