The Competition Authority decided to impose an administrative fine of 64 million 812 thousand 992 lira on İntema İnşaat ve Tesisat Malzemeleri Yatırım ve Pazarlama AŞ as a result of a settlement.

In a statement published on the website of the Competition Authority, it was reported that the investigation conducted to determine whether İntema İnşaat ve Tesisat Malzemeleri Yatırım ve Pazarlama AŞ violated the Law on the Protection of Competition by setting resale prices, imposing restrictions on the regions where dealers can offer products, on resellers and customers, and imposing a single-source purchasing obligation with a competition ban on its dealers has been concluded with a settlement and commitment.

In the statement, it was reported that an administrative fine of 64 million 812 thousand 992 lira was imposed for the allegation of setting resale prices, and the following expressions were used; "The allegations that the company imposed restrictions on the regions where dealers can offer products and on customers were addressed in the commitment letter regarding the competition ban and single-source purchasing obligation included in the contracts signed with different dealers. It has been decided to accept the submitted commitments and to conclude the investigation regarding the aforementioned allegations by making the commitments binding for the company."
"RELEVANT PROVISIONS OF THE CONTRACTS WILL BE AMENDED"
The statement included the commitments submitted by the company, stating; "In this context, the relevant provisions of the contracts signed with resellers of different dealership statuses will be amended. It will be clarified that there are no restrictions on the regions and customer groups where resellers can conduct active and passive sales. It will be clarified that the commission system applied to Vitra sales points and secondary sellers is not based on regional allocation.
A notification letter clarifying that purchases made by sales points or secondary sellers from authorized sellers located outside their operating region are also subject to commission will be shared with resellers. The competition restriction provisions in the contracts signed with different dealers of İntema will be removed from the contract regarding the non-competition obligation in the Vitra Sales Point Agreement signed with authorized sellers concerning the 'concealed cistern' product group. The competition restriction provisions regarding the single-source purchasing obligation in the İntema Authorized Dealer, İntema Vitra Sales Point, and İntema Kitchen Authorized Dealer contracts will be removed from all relevant contracts."
COMMITMENTS WILL BE IMPLEMENTED WITHIN 4 MONTHS
The statement indicated that the aforementioned commitments would be implemented within 4 months from the notification of the short decision and would be valid indefinitely, and it was concluded that individual exemptions could also be granted regarding the non-competition obligation in the Authorized Dealer Agreement signed with the company's authorized dealers.
