A lawsuit has been filed against the driver who caused the death of teacher Mevlüt Külcü by crashing into his vehicle from behind at a speed of 229 kilometers per hour while he was waiting at a red light in Konya, on charges of "intentional homicide with possible intent," with a request for up to 25 years in prison. In his defense, the defendant claimed that he could not remember how he drove the vehicle after the halfway point of the road.

The indictment prepared against the driver İsmail A., who was arrested as part of the investigation initiated by the Konya Chief Public Prosecutor's Office following the accident, has been completed.

In the indictment accepted by the Konya 3rd Heavy Penal Court, it was requested that the defendant be sentenced to imprisonment of 20 to 25 years for the crime of "intentional killing with possible intent."

Defendant İsmail A. claimed that he does not remember how he drove the vehicle after halfway through the road, stating:

"I left my residence to go to my workplace. While driving on the Çayırbağı road, my speed was 68 kilometers per hour. I do not remember how I drove the vehicle after halfway through the road. I may have lost my senses due to heavy exercise and heavy eating the day before the accident. I was fine until halfway through the road; I do not know what happened afterwards. I had a psychological disorder in 2006-2007. I did not take the medications prescribed in 2020. I am sorry about the incident."

ATTENTION WAS DRAWN TO TWO RED LIGHT VIOLATIONS ON THE DAY OF THE ACCIDENT

The visual examination report included in the indictment noted that the defendant violated the red light twice while driving and crashed into a vehicle waiting at the red light at high speed.

It was reported that the defendant was not under the influence of alcohol and that no drugs or stimulants were detected in the samples taken from his body.

According to the accident report, it was stated in the indictment that the defendant violated the rules that contributed to the occurrence of the accident by not reducing the speed of his vehicle, while the victim did not have any rule violations.

"According to the calculations made from the cameras that observed the defendant's vehicle, it was determined that the defendant's speed was 229 kilometers per hour. As a result of the technical examinations conducted on the defendant's vehicle, it was found that there were no technical problems in the brake system, engine and transmission sections, electronic system, and front suspension section, and that there was no ongoing issue. It was also determined that the vehicle had passed the last inspection with minor faults and that the general maintenance of the vehicle was performed at a private service on September 21, 2025. A report was prepared stating that the accident did not arise from a technical problem."

THE DEFENDANT'S CLAIMS WERE REFUTED BY EVIDENCE

Although the defendant made different statements in his defense, it was evaluated that his claim of possibly having a disturbance at the time of the accident, as he had a phone conversation just before the accident, was aimed at evading the crime. Although the defendant's spouse stated that there were malfunctions in the vehicle, the expert report indicated that no mechanical faults that could have caused the accident were detected.

EVALUATION OF POSSIBLE INTENT

Regarding the evaluation of possible intent in the indictment, the following was recorded:

"In light of the evaluation of possible intent, it is seen that the defendant violated the red light twice before the accident and was talking on the phone with witness Y.F.E. while driving at a speed significantly above the local conditions. At the time of the accident, according to the camera footage, the defendant, at a speed of 229 kilometers per hour, crashed into a vehicle waiting at the red light from behind without braking or taking any preventive measures, despite foreseeing that other vehicles would be waiting at the red light, causing the victim's death. When the defendant's actions before and during the accident are evaluated as a whole, it is understood from the entire investigation file that although he did not intend the result of the victim's death, he acted with possible intent by remaining indifferent to the fact that the result was likely to occur."

The car driven by İsmail A. crashed into the vehicle driven by chemistry teacher Mevlüt Külcü, who was waiting at a red light at an intersection on the Antalya ring road in the Meram district of Konya on October 3. İsmail A., who was injured in the accident where Külcü lost his life, was arrested after his treatment at Konya City Hospital.
