In the case regarding the death of Gamze Yağlıoğlu, who fell from the balcony of her apartment on the 6th floor where she lived in the Alanya district of Antalya four years ago, the regional appellate court that reviewed the appeal file of her husband Alper Yağlıoğlu, who was sentenced to aggravated life imprisonment, ruled for the acquittal and release of the defendant.

On November 24, 2021, Gamze Yağlıoğlu, who fell from the balcony of her apartment on the 6th floor in Alanya, lost her life. In the investigation regarding Yağlıoğlu's death, her husband Alper Yağlıoğlu was detained and arrested.

Alper Yağlıoğlu, who is being tried for the crime of 'Intentional Murder of His Wife' at the Alanya 2nd Heavy Penal Court, was sentenced to aggravated life imprisonment on the grounds that he pushed his wife from the balcony, causing her death. In the reasoned decision of the court, it was stated that it was impossible for Gamze Yağlıoğlu, who was 1 meter 68 centimeters tall, to jump without holding onto the railing, which was 1 meter 12 centimeters high, and that no fingerprints or grip marks were found, while there were signs of friction. It was noted that Gamze Yağlıoğlu's death occurred as a result of the defendant pushing her from the balcony. The decision also stated that a DNA profile belonging to the defendant was found under Gamze Yağlıoğlu's nails.

"I RECEIVED A SENTENCE WHILE WAITING FOR ACQUITTAL"

The defendant Alper Yağlıoğlu, who appealed the decision, appeared before the judge at the 4th Criminal Chamber of the Antalya Regional Court of Appeal. The lawyers of both parties were also present in the courtroom. In his defense, Alper Yağlıoğlu stated that his wife Gamze Yağlıoğlu committed suicide, saying, "I went to the beach on the day of the incident. I did not see how Gamze fell. When I left the house, she was lying down. When I came home, I looked down from the balcony. When I went downstairs, I encountered Gamze's body. I was branded a murderer. I received a sentence while waiting for acquittal. I loved Gamze very much. She was the most valuable person in my life. It hurts to be remembered as the murderer of the person I loved the most," he said.

Responding to the court regarding whether he deleted any evidence from Gamze Yağlıoğlu's phone, Alper Yağlıoğlu said, "I did not touch Gamze's phone when I came home. It is said that I deleted something from her phone. I did not do that. I did not go on Instagram while I was at the head of Gamze's corpse. I may have accidentally entered while calling 112. It is said that I acted calmly. Both Gamze and I are calm people. That's why we were together for 12 years. I am not a healthcare professional. As we see on television, you do not touch the injured. I did not touch her when I went to her head. My wife committed suicide," he said.

"THERE IS NO REASON FOR MY DAUGHTER TO COMMIT SUICIDE"

Neşe Kıraç, who stated in court that her daughter did not commit suicide and that there was no reason for it, said, "On the day of the incident, I spoke with my daughter on the phone. Gamze was a hardworking, ambitious, and determined girl. She was interested in many sports. She was a very capable person. There is no reason for my daughter to commit suicide. Additionally, Gamze has a fear of heights. She cannot even look down from the balcony to throw herself off. She never received psychological treatment even once. Alper was putting psychological pressure on her. He was saying that he no longer liked Gamze after they got married," she said. The court decided to acquit and release Alper Yağlıoğlu, who was being tried in detention, due to the principle of 'the defendant benefits from doubt' and lack of evidence.

"WHAT HAPPENED TO MY CHILD HAS HAPPENED, I WILL NEVER GIVE UP"

Neşe Kıraç, who reacted to the release of Alper Yağlıoğlu, said, "The court has concluded, the defendant has been acquitted. Despite the presence of many pieces of evidence in the file, he was acquitted. We did not expect this decision at all. The national forensic evidence was very clear, and there were many pieces of evidence from both physical, scientific, and technical perspectives. But how did such a decision come about? I am very shocked. I did not expect it at all. I am very sad. What happened to my child has happened. But this is not the end. I will never give up. We will continue, of course. One day he will pay for it. Whether it is this way or that way, there is divine justice. My trust in justice is always infinite. One day, everything will come to light. I will continue to fight. This is not over here," she said.

"WE BELIEVE THERE WAS A GROSS LEGAL ERROR"

Bilge Savran, the lawyer of Neşe Kıraç, who stated that they would appeal the decision, said, "A very wrong decision was made. Unfortunately, the decision of the local court, which imposed an aggravated life sentence without any reductions and was fully aware of the case, was overturned and annulled solely based on the principle of 'the defendant benefits from doubt' and the claim of lack of evidence. We believe that this result will be corrected in the Court of Cassation. We will appeal. We are confident that justice will ultimately be served. We believe that the decision made today is very wrong and constitutes a gross legal error," he said.
