Gültekin Alan, who was sentenced to aggravated life imprisonment for allegedly killing the murderer of Özgecan Aslan and whose sentence was upheld, stated, "We four decided together to commit this murder. One of them is Ferat Y., another is Ahmet Tekin B., and the other is Adem Ç. It was Ahmet Tekin B. who brought the weapon into the prison. Ferat Y. is the one who paid for the expenses of bringing the weapon into the prison."
The murderer of 20-year-old university student Özgecan Aslan, who was killed in a minibus in the Tarsus district of Mersin, is 26-year-old Ahmet Suphi Altındöken. There has been a new development regarding the case related to his death in Adana Prison and the injury of his father, Necmittin Altındöken.
The Supreme Court of Appeals upheld the aggravated life sentence and 29 years, 9 months, and 10 days of imprisonment for Gültekin Alan, who is accused of killing Ahmet Suphi Altındöken in prison. This decision was made following the acquittal of other defendants and the subsequent retrial, where the local court issued a third acquittal decision regarding the defendants.
Since his sentence was upheld, Gültekin Alan, who was heard as a witness during the sentencing hearing, claimed that four people decided together to commit the murder, stating, "One is Ferat Y., one is Ahmet Tekin B., and the other is Adem Ç. Ahmet Tekin B. is the one who brought the gun into the prison. Ferat Y. is the one who paid for the gun's entry into the prison," he said.
THEY KILLED IN THEIR CELL Özgecan Aslan's murder suspect, convict Ahmet Suphi Altındöken, and his father Necmittin Altındöken were attacked by convict Gültekin Alan with a gun in their cell on April 11, 2016. In the attack, Ahmet Suphi Altındöken was killed, and his father was injured. In the investigation initiated regarding the attack, Gültekin Alan, along with prison guard Hacı Ahmet Ö., convict Hüsamettin B. who is accused of bringing the gun into the prison, his wife Gamze B., and Ahmet Tekin B., Ferat Y., and Serkan A. were charged in the Adana 5th High Criminal Court.
The court panel sentenced Gültekin Alan to aggravated life imprisonment for 'premeditated murder'. Additionally, Alan received 18 years for 'attempted premeditated murder', 1 year and 4 months for 'insult', 6 years for 'bringing prohibited items into the prison, violating Law No. 6136', and 4 years, 5 months, and 10 days for 'depriving prison guards of their freedom', totaling 29 years, 9 months, and 10 days of imprisonment. Other defendants were acquitted due to lack of evidence.
SUPREME COURT OVERTURNED THE DECISION Upon the request of the Adana Chief Public Prosecutor's Office and Alan's petition stating 'I will provide detailed testimony', the 1st Criminal Chamber of the Supreme Court overturned the local court's decision. Following the Supreme Court's decision, the case was retried at the Adana 5th High Criminal Court, where the prosecutor requested the conviction of Gültekin Alan for 'premeditated murder', 'attempted premeditated murder', 'bringing prohibited items into the penal institution', and 'depriving a person of their freedom', and also requested that defendant Ahmet Tekin B. be convicted of 'instigating premeditated murder', 'instigating attempted premeditated murder', and 'bringing prohibited items into the penal institution'.
In the hearing following the overturning decision, Gültekin Alan, who is accused of killing Özgecan Aslan's murderer and attempting to kill his father, claimed that he knows the details of the case better than all the other defendants, and accused the lawyers and officials he named in his petition sent to the court, including defendants Ahmet Tekin B. and Ferhat Y. Other defendants denied Alan's claims and stated that they had no involvement in the incident, requesting their acquittal.
THE LOCAL COURT ISSUED THE SAME DECISION The court panel, disregarding Gültekin Alan's defenses, resisted the overturning decision and sentenced defendant Alan to the previously given aggravated life sentence and an additional total of 29 years, 9 months, and 10 days of imprisonment. The other defendants were also acquitted again due to lack of evidence.
The 1st Criminal Chamber of the Supreme Court did not find it appropriate for the local court to insist on its previous decisions regarding the defendants made on November 2, 2021, and sent the case file to the Supreme Court General Assembly due to a conflict.
In its evaluation, the Supreme Court General Assembly decided to uphold the conviction of the local court regarding defendant Gültekin Alan. Regarding the acquittal decisions for other defendants Hüsamettin B., his wife Gamze B., and Ahmet Tekin B. and Ferat Y. for 'qualified intentional murder and attempted qualified intentional murder', it was decided to overturn the verdict due to insufficient investigation regarding whether the mentioned crimes were established. It was noted that two members of the Criminal General Assembly, who did not agree with the majority opinion, voted against on the grounds that "the conviction of defendant Gültekin Alan was also established with insufficient investigation".
ALAN: WE DECIDED TO COMMIT THE MURDER WITH 4 PEOPLE Following the Supreme Court General Assembly's overturning decision regarding the other defendants besides Gültekin Alan, the case file was sent back to the local court. In the third hearing of the case at the Adana 5th High Criminal Court, Gültekin Alan, whose decision was upheld, was heard as a witness. Alan stated, "You did not punish those who brought the gun into the prison, so I will not disclose the names of those who brought the gun into the prison. Therefore, I will not make a statement regarding those who brought the gun into the prison. You accused Hüsamettin and his wife regarding the entry of this gun. Those people have nothing to do with this crime. My decision was upheld; why are you asking me this?"
Upon the court president's statement that the acquittal decisions were partially overturned, Alan said, "If the acquittal decisions were overturned, I will say this. We decided to commit this murder together with 4 people. One is Ferat Y., one is Ahmet Tekin B., and the other is Adem Ç. Ahmet Tekin B. is the one who brought the gun into the prison. Ferat Y. is the one who paid for the gun's entry into the prison," he said.
The defendants requested their acquittal, rejecting Alan's claims.
NOT FOUND CREDIBLE The court panel did not find the statement of Gültekin Alan, who was sentenced to aggravated life imprisonment and 29 years, 9 months, and 10 days of imprisonment, credible.
The court decided to acquit the defendants individually, as no conclusive and convincing evidence was obtained that would eliminate any doubt regarding the defendants' commission of the crimes of 'qualified intentional murder and qualified attempted murder.' However, no decision was made regarding the defendant Ferat Y. due to a clerical error in the preliminary ruling. Following the later discovery of the error, it was decided that the case would continue concerning the defendant Ferat Y.
REASONED DECISION In the reasoned decision of the court, it was emphasized that the fundamental condition for a defendant to be punished for a crime is that the crime must be proven with certainty that leaves no room for doubt. It was stated that, "Although a public case was opened against the defendants Hüsamettin B. and Gamze B. for 'premeditated murder, attempted premeditated murder,' and against the defendant Ahmet Tekin Baykal for 'instigation to commit premeditated murder, instigation to attempt premeditated murder,' and against the defendant Hacı Ahmet Özdoğan for 'premeditated murder, attempted premeditated murder,' based on the indictment of the Adana Chief Public Prosecutor's Office; the statements of the defendant Gültekin Alan, supported by other evidence indicating that the other defendants had no connection to the accusations in his written and verbal defenses before the reversal, his contradictory statements given after the reversal, the defendants' consistent defenses aimed at denial, the statements of the victim's prison guards, and the report prepared by the experts on 19/12/2016, which indicated that there was no footage regarding whether Gültekin Alan had a gun under his clothes and at his waist or how he obtained the gun between the hours of 14:23 and 14:26 on 11/04/2016 when he was released from the ward, and that Ahmet Tekin Baykal, who was among the guards in front of the ward door, made hand gestures to calm Gültekin Alan by raising his left hand, but it was reported that it could not be understood what he said as there was no audio recording on the cameras; when all the evidence in the file is considered together, it was concluded that no conclusive and convincing evidence was obtained that would eliminate any doubt regarding the punishment of the defendants. Therefore, taking into account the principle that the defendant benefits from doubt, it was decided to acquit the defendants Hüsamettin and Gamze B., Ahmet Tekin B., and Hacı Ahmet Ö. due to insufficient evidence in accordance with Article 223/2-e of the Code of Criminal Procedure No. 5271."
