The Antalya Chief Public Prosecutor's Office, in the Muhittin Böcek case, issued a decision of lack of jurisdiction regarding the investigation conducted into Özgür Özel, Veli Ağbaba, Ali Mahir Başarır, Umut Akdoğan, Mustafa Erdem, and Cavit Arı, and sent the case file to the Ankara Chief Public Prosecutor's Office for the preparation of a legal opinion. If the Ankara Chief Public Prosecutor's Office determines that there is sufficient suspicion, it may prepare a legal opinion as a basis for the request to lift the parliamentary immunity of the deputies.

The Antalya Chief Public Prosecutor's Office issued a ruling of lack of jurisdiction in the case regarding allegations of money demands and deliveries related to the Antalya Metropolitan Municipality mayoral candidacy process before the 2024 local elections. The file was sent to the Ankara Chief Public Prosecutor's Office to prepare a report on Özgür Özel, Veli Ağbaba, Ali Mahir Başarır, Umut Akdoğan, Mustafa Erdem, and Cavit Arı.

The investigation into individuals and actions other than members of parliament will be conducted by the Antalya Chief Public Prosecutor's Office.

If the Ankara Chief Public Prosecutor's Office determines that there is sufficient suspicion regarding the members of parliament, they may then prepare a report that will serve as the basis for a request to lift legislative immunity for the members of parliament.

THE FILE IN ANTALYA WAS SENT TO ANKARA

The Antalya Chief Public Prosecutor's Office issued a ruling of lack of jurisdiction in the investigation conducted against CHP Chairman Özgür Özel and CHP members of parliament Veli Ağbaba, Ali Mahir Başarır, Umut Akdoğan, Mustafa Erdem, and Cavit Arı. The file was sent to the Ankara Chief Public Prosecutor's Office to evaluate the process of preparing a report.

INVESTIGATION BASED ON CANDIDACY PROCESS ALLEGATIONS

The investigation, conducted by the Antalya Chief Public Prosecutor's Office's Terrorism and Organized Crimes Investigation Bureau, covers allegations of money demands and money deliveries related to the Antalya Metropolitan Municipality mayoral candidacy process before the 2024 local elections.

In the evaluation made by the Chief Public Prosecutor's Office, the statements, HTS and base station records, and other evidence in the file were examined together.

WHAT ALLEGATIONS ARE IN THE FILE?

It was stated that within the scope of the investigation, there are allegations that money was demanded at the CHP Headquarters, that the said money was procured and delivered in Ankara, and that the process was coordinated through various meetings.

According to the statements in the file, it was alleged that 1 million euros were demanded as part of the candidacy process and that this money was delivered to a person allegedly connected to the CHP Headquarters.

HTS AND BASE STATION RECORDS EXAMINED

In the Chief Public Prosecutor's Office statement, it was stated that it was assessed that the parties were in intense communication traffic in Ankara, particularly around the CHP Headquarters, on the dates when the money delivery was claimed to have taken place.

It was noted that conversations between some members of parliament and suspects occurring in the same time period were also evaluated together with the allegations in the file.

RULING OF LACK OF JURISDICTION ISSUED

The Prosecutor's Office stated that, according to Article 161/9 of the Criminal Procedure Code, the authority to conduct investigations into members of the Grand National Assembly of Turkey belongs to the Ankara Chief Public Prosecutor's Office.

Therefore, a ruling of lack of jurisdiction was issued regarding the investigation into Özgür Özel, Veli Ağbaba, Ali Mahir Başarır, Umut Akdoğan, Mustafa Erdem, and Cavit Arı, and it was decided to send the file to the Ankara Chief Public Prosecutor's Office.

It was reported that the investigation into suspects and actions other than members of parliament continues separately by the Antalya Chief Public Prosecutor's Office.

HOW DOES THE REPORT PROCESS WORK?

The report prepared by the authorized prosecutor's office in investigations conducted against members of parliament is sent to the Speaker's Office of the Grand National Assembly of Turkey through the Ministry of Justice. The file is then examined in the Joint Commission of the Grand National Assembly of Turkey. If the General Assembly decides to lift immunity in line with the commission's report, the path to the trial process against the member of parliament can be opened.
