In the case of the Gezi Park protests, the judge who ordered the release of the detained manager Ayşe Barım was removed from their position and appointed as a consumer court judge in the same courthouse.
HSK, the judiciary body, removed the criminal court judge Fatih Kapan, who issued a release decision for the detained manager Ayşe Barım in the investigation of the Gezi Park protests, and appointed him to the consumer court.
The Judges and Prosecutors Council (HSK) made a decision regarding Fatih Kapan, the Istanbul 8th Criminal Court judge, who initiated an examination and investigation against him for issuing a release decision for the detained manager Ayşe Barım in the investigation of the Gezi protests.
POSITION CHANGED
According to the decision made by HSK, criminal court judge Fatih Kapan was removed from his position and appointed to the consumer court in the same courthouse.
RELEASE DECISION WAS MADE, REARRESTED WITHOUT LEAVING
In the investigation regarding the allegations in the media that manager Emine Ayşe Barım participated in the Gezi Park protests in Taksim, her lawyers applied to the peace criminal court to appeal against her detention.
The court, which evaluated the request, rejected the appeal and decided to continue Barım's detention. Following this, Barım's lawyer appealed against her detention again and applied to the Istanbul 8th Criminal Court.
The judge of the court, Fatih Kapan, who evaluated the appeal, stated that "the nature and characteristics of the crime attributed to the suspect, the witness statements in favor of her, the phone call records against her, and all evidence indicate that there is a possibility of change in the crime, and in this case, the detention decision would not be proportionate," and issued a release decision.
Following this, the Istanbul Chief Public Prosecutor's Office appealed against the decision before Barım's release was realized. The Heavy Criminal Court, which found the prosecutor's request valid, issued a new arrest warrant for Barım.
