The justification for the decision regarding the life imprisonment sentence of Bedirhan Şener, the son of former minister Abdüllatif Şener, who shot and killed his grandmother in Ankara, has been announced. According to the reasoned decision of the Ankara 1st Heavy Penal Court, on July 31, 2014, his grandmother, the victim Leyla Çetiner, and his mother, the complainant Berrin Şener, went to his residence to meet Bedirhan Şener, during which Abdüllatif Şener was outside the apartment to park his vehicle.

"HE FIRED AS SOON AS HE OPENED THE DOOR"

In the reasoned decision, it was stated that Leyla Çetiner and Berrin Şener rang the doorbell, and as soon as Bedirhan Şener opened the door, he fired with a gun belonging to Abdüllatif Şener. It was noted that mother Şener ran away from the door, while Leyla Çetiner, who was hit by the bullets, died at the scene.

"9 BULLETS HIT HIS BODY"

The reasoned decision, which also included the report of the Forensic Medicine Institution, stated that Çetiner was hit by 9 bullets, and it was determined that the victim died as a result of "internal and external bleeding due to skull dome, base, and skeletal system bone fractures caused by gunshot wounds, along with damage to internal organs and major vessels."

"FULL CRIMINAL CAPACITY AT THE TIME OF THE CRIME"

In the reasoned decision, it was mentioned that the defendant's lawyers argued during the hearings that their client's mental health was not intact, and therefore he lacked criminal capacity. However, it was noted that reports from the forensic medicine institution indicating that Şener had full criminal capacity were submitted to the case file on different dates.

It was stated in the reasoned decision that no mental illness or intellectual disability that would eliminate or significantly reduce Şener's criminal responsibility was detected, and it was concluded that "in the examination of the judicial file, there was no medical evidence or document indicating that the defendant was in a mental state that would eliminate or reduce his ability to comprehend the legal meaning and consequences of the act he committed or to direct his behavior at the time he committed the aforementioned crime."

"FIRING WAS DONE FROM A VERY CLOSE DISTANCE"

In the decision stating that the defendant intentionally committed the murder, the following determinations were made: "It has been established that the defendant Şener fired at the victim from a very close distance with a pistol, causing the bullets to hit vital areas of Çetiner, resulting in death, and in this regard, it has been determined that the defendant's intent to kill the victim was 'direct intent.'

"THE ACT WAS COMMITTED INTENTIONALLY"

Although the defendant and his defenders argued that the defendant did not have the intent to kill his grandmother and that the act of firing was directed at an empty space, claiming that he did not know he was shooting at his grandmother due to his mental disturbance at the time of the incident, it has been established through the reports in the case file that the defendant had full criminal capacity at the time of the crime, his confession regarding the act of firing, and the victim's statements, when evaluated together with all the expert reports in the case file, it has been determined that the defendant intentionally committed the act of 'intentional killing of a relative by blood.'

It was reminded in the reasoned decision that a public case was opened against the defendant for attempting to kill his mother Berrin Şener, but it was recorded that he fired multiple times without any concrete, definitive, and convincing evidence showing that he targeted his mother, and therefore he was acquitted of the charged crime in accordance with the universal principle of "in case of doubt, the defendant benefits."

"SENTENCED TO LIFE IMPRISONMENT"

In this context, it was reported that the defendant Şener was sentenced to life imprisonment for the crime of "intentional killing of a relative by blood" for killing his grandmother Leyla Çetiner with a firearm, and also received a sentence of 1 year and 8 months for the crime of "possessing an unlicensed firearm."
