With the Law on Amendments to the Highway Traffic Law, which was accepted by the Grand National Assembly of Turkey and published in the Official Gazette, the penalties for speed violations have been restructured. While a distinction between urban and rural areas has been introduced, the percentage penalty system has been abolished and a new 9-tier penalty system has been implemented. Speed limits can be exceeded by a maximum of 6 kilometers within urban areas and by 11 kilometers outside urban areas.

With the changes made, a new era has begun in speed controls and penalty applications in traffic.

PERCENTAGE SLICE REMOVED

Accordingly, the penalty system previously applied based on percentage slices according to the rate of exceeding the speed limit has been removed, and a 9-tier system determined by the exceeded kilometer value has been implemented. Additionally, speed rules have been classified into two separate statuses: "within residential areas" and "outside residential areas."

PENALTIES WILL BE DETERMINED BASED ON EXCEEDED KILOMETERS

As a result of detections made by speed measuring technical devices or various technical methods, those exceeding the speed limits specified in the regulation by 6-10 kilometers/hour within residential areas will be fined 2,000 lira, those exceeding by 11-15 kilometers/hour will be fined 4,000 lira, those exceeding by 16-20 kilometers/hour will be fined 6,000 lira, those exceeding by 21-25 kilometers/hour will be fined 8,000 lira, those exceeding by 26-35 kilometers/hour will be fined 12,000 lira, those exceeding by 36-45 kilometers/hour will be fined 15,000 lira, those exceeding by 46-55 kilometers/hour will be fined 20,000 lira, those exceeding by 56-65 kilometers/hour will be fined 25,000 lira, and those exceeding 66 kilometers/hour or more will be fined 30,000 lira as an administrative fine.

For the specified speed limits, those exceeding by 11-15 kilometers/hour outside residential areas will be fined 2,000 lira, those exceeding by 16-20 kilometers/hour will be fined 4,000 lira, those exceeding by 21-25 kilometers/hour will be fined 6,000 lira, those exceeding by 26-30 kilometers/hour will be fined 8,000 lira, those exceeding by 31-40 kilometers/hour will be fined 12,000 lira, those exceeding by 41-50 kilometers/hour will be fined 15,000 lira, those exceeding by 51-60 kilometers/hour will be fined 20,000 lira, those exceeding by 61-70 kilometers/hour will be fined 25,000 lira, and those exceeding 71 kilometers/hour or more will be fined 30,000 lira as an administrative fine.

HERE ARE THE NEW LIMITS

For example, on roads where the speed limit is set at 50 kilometers/hour within residential areas, a speed of 56 kilometers/hour, on roads where the limit is set at 70 kilometers/hour, a speed of 76 kilometers/hour, and on roads where the limit is set at 82 kilometers/hour, a speed of 88 kilometers/hour will be considered the beginning of a speed violation.

Outside residential areas, on roads where the speed limit is 90 kilometers/hour, a speed of 101 kilometers/hour, on roads where the limit is 110 kilometers/hour, a speed of 121 kilometers/hour, and on roads where the limit is set at 130 kilometers/hour, a speed of 141 kilometers/hour will be evaluated as the beginning of a violation.

RETRIEVAL OF DRIVER'S LICENSES

Those who violate the speed limit by 46-55 kilometers/hour within residential areas will have their driver's licenses taken for 30 days each time, those who violate by 56-65 kilometers/hour will have their licenses taken for 60 days each time, and those who violate by more than 66 kilometers/hour will have their licenses taken for 90 days each time.

The location of the inspection to be conducted in settlements with a population of less than 5,000 will be determined by the local administrative authority.

Outside residential areas, those exceeding the speed limit by 51-60 kilometers/hour will have their driver's licenses taken for 30 days each time, those exceeding by 61-70 kilometers/hour will have their licenses taken for 60 days each time, and those exceeding by more than 71 kilometers/hour will have their licenses taken for 90 days each time.

To return the taken driver's licenses, all administrative fines imposed must be collected. Additionally, driver's licenses taken for the fifth time within one year from the date of the last violation will be returned at the end of the retrieval period, provided that it is understood that there is no obstacle to obtaining a driver's license after the driver has undergone a psychotechnical evaluation and examination by a psychiatry specialist.

The production, importation, and possession of any devices used to detect whether speed limits have been exceeded or to warn the driver will be prohibited.

Those who manufacture and import these devices will be fined 370,000 lira, even if the act constitutes another crime, and those who possess these devices in their vehicles will be fined 185,000 lira. Additionally, these devices will be confiscated by the local authority, and it will be decided to transfer their ownership to the public.

The Law on Amendments to the Highway Traffic Law, which includes this regulation, was published in the Official Gazette on February 27 and has come into effect.

Speed fines:

  • 6-10 km/h over: 2,000 TL
  • 26-35 km/h over: 12,000 TL
  • 46-55 km/h over: 20,000 TL
  • 66 km/h and above: 30,000 TL

License confiscation:

  • 46-55 km/h over: 30 days
  • 56-65 km/h over: 60 days
  • 66 km/h and above: 90 days

A fine of 185,000 TL will also be imposed on those who possess radar detection devices.
