The 19 years and 2 months prison sentence given to Mervenur Uluyol, who killed her husband in Kayseri, was overturned by the appellate court due to the lack of a report regarding the defendant's mental health and procedural deficiencies; the case will be retried.
In Kayseri, Mervenur Uluyol (29), who stabbed and killed her husband Ahmet Uluyol (31) on the grounds that he was abusing her, was sentenced to 19 years and 2 months in prison with a reduction for provocation in the case she is being tried in custody. This decision was overturned by the Kayseri Regional Court of Appeals on the grounds that a 'mental health' report was not obtained for the defendant.
The incident occurred on November 4, 2023, around 03:00, at the Denizhan Mansion in the Yunusemre neighborhood of the Kocasinan district. Mervenur and Ahmet Uluyol, who have 2 children, had a fight. After the fight, it is claimed that Ahmet Uluyol went to sleep. Mervenur Uluyol stabbed her husband Ahmet Uluyol in the chest after a while. Police and medical teams were dispatched to the address upon the notification of neighbors who heard the screams. The medical team determined that Ahmet Uluyol had died. Uluyol's body was buried in his hometown of Yahyalı. Mervenur Uluyol, who was taken into custody, was arrested.
"IF I WERE MENTALLY ILL..."
After the investigation conducted by the Kayseri Chief Public Prosecutor's Office, an indictment was prepared, and a case was filed against Mervenur Uluyol for the crime of 'Intentional Murder of Her Husband' with a request for aggravated life imprisonment. During the sentencing hearing of the case seen at the Kayseri 2nd High Criminal Court, Mervenur Uluyol said, "If I were mentally ill, I wouldn't let myself be oppressed. Ahmet couldn't oppress me. I was tortured for years, I even asked for help from his family. No one helped me. I filed complaints 11 times. My face was swollen, I ran away from home and slept in cemeteries."
PUNISHMENT REDUCED TO 19 YEARS
The court panel sentenced the defendant Mervenur Uluyol to aggravated life imprisonment for the crime of 'Intentional Murder of Her Husband.' The panel then applied a 'provocation' reduction, reducing her sentence to 19 years and 2 months.
CASE TAKEN TO APPEAL
Upon the objection of the parties' lawyers, the case was taken to the Kayseri Regional Court of Appeals. After the examination by the 1st Criminal Chamber, it was determined that some witness statements were taken without a prosecutor in the local court, and that a judgment was made without determining whether the defendant Uluyol had criminal capacity, leading to a decision to overturn the case. The chamber decided to obtain a 'mental health' report for the defendant and sent the case back to the local court.
Defendant Mervenur Uluyol will appear before the judge again in the coming days.
