In a statement regarding the cancellation decision for the CHP Istanbul Provincial Congress, Justice Minister Yılmaz Tunç said, "The interim decision issued by the court is a precautionary measure aimed at preventing irreparable damages that may arise during the trial process and does not constitute a final ruling. The trial process is ongoing." Tunç also mentioned that there is a right to appeal the decision.
On October 8, 2023, the Istanbul 45th Civil Court of First Instance ruled for the removal of Provincial Chairman Özgür Çelik and the current administration in the case opened for the cancellation of the CHP Istanbul Provincial Congress. It was decided to temporarily suspend the duties of 196 delegates, and the ongoing congress process was also halted. A committee consisting of Gürsel Tekin, Zeki Şen, Hasan Babacan, Müjdat Gürbüz, and Erkan Narsap was appointed temporarily to the CHP Istanbul Provincial Presidency.

Following the developments, Justice Minister Yılmaz Tunç made a statement regarding the issue. In a statement on his social media account, Minister Tunç reminded that the trial process is ongoing and stated that the decision is a precautionary measure aimed at preventing irreparable damages that may arise during the trial process and does not constitute a final judgment.
In his statement, Minister Tunç included the following remarks: "Due to the irregularities, allegations of interest procurement, and actions aimed at influencing the will of voters raised by the CHP Istanbul Provincial and Congress Delegates, with the interim decision given in the case opened at the Istanbul 45th Civil Court of First Instance;
It has been decided to temporarily suspend the duties of the Provincial Chairman, the Main and Alternate Members of the Provincial Board of Directors, and the Main and Alternate Members of the Provincial Disciplinary Board elected at the 38th Ordinary Istanbul Provincial Congress of the Republican People's Party, to appoint a temporary committee to exercise the powers of the provincial chairman, provincial board of directors, and provincial disciplinary board, and to temporarily suspend the election processes of the district congresses and Provincial Congress that will only be conducted by the Istanbul Provincial Organization as part of the 39th Ordinary Congress process.
"THE APPEAL PATH IS OPEN"
The requests for the temporary removal of the delegates of the Republican People's Party's 38th Ordinary Istanbul Provincial Congress and for the suspension of all decisions made at the Istanbul Provincial Congress have been rejected. According to Article 394 of the Civil Procedure Code, the appeal path is open for the decisions accepted by the court, and it has been decided that an appeal can be made to the Istanbul Regional Court of Appeals regarding the rejected parts of the decision in accordance with Article 391 of the Civil Procedure Code.
