Justice Minister Yılmaz Tunç, who met with judicial reporters in Antalya, gave a noteworthy response to a question regarding the release of former HDP Co-Chair Selahattin Demirtaş, whose release is on the agenda. Minister Tunç stated, "The decision regarding Selahattin Demirtaş is before the court; we will all wait together."

Regarding the decision of the European Court of Human Rights (ECHR) concerning the former co-chair of the HDP, Selahattin Demirtaş, who has been imprisoned since 2016, Minister Tunç said, "The decision of the chamber will currently be evaluated by the 22nd Criminal Chamber of the Regional Court of Appeal."



Stating that the evaluation is currently before the court, Tunç said, "We will all wait together to see what decision the court will make."



PENALTIES FOR THOSE WHO USE CHILDREN TO COMMIT CRIMES WILL INCREASE



Indicating that regulations regarding children who are led to crime will be included in the 11th Judicial Package, Tunç stated, "It is proposed to increase the penalties for those who lead children to crime and use children as tools in crimes."



With the proposal, it is indicated that the lower and upper limits of prison sentences for the crimes of establishing, managing, and being a member of an organization will be increased. "Thus, it is aimed to combat crime more effectively and to ensure social peace and tranquility," he expressed.



"THOSE WHO USE CHILDREN AS TOOLS COULD FACE 30 YEARS IN PRISON"



Tunç shared the details of the regulations: "The penalty for the crime of establishing and managing an organization will be increased from 4 years to a maximum of 8 years in prison, while it will be raised from 5 years to 10 years. The upper limit of the penalty for the crime of membership in an organization is set at 4 years, while it will be determined as 5 years in prison. Again, if the organization is armed, the increase in the penalty will be regulated to be only half of the quarter increase. Accordingly, while a person managing an armed organization will receive a prison sentence of 5 to 12 years, according to the proposal, the sentence could be increased to 7 years and 6 months to 15 years.



On the other hand, in cases where children are used as tools in crimes committed within the framework of the organization's activities, it is accepted that the penalty to be given to the organization leaders will be increased by up to one fold of half of the penalty. For example, the penalty to be given to an organization leader who forces a child to shoot a place, threatens someone, or causes injury will be increased by one fold of half. Accordingly, if the lower limit of the prison sentence is 7 years and 6 months and it is increased by 1/2, it will become 11 years and 3 months; if the upper limit of the prison sentence is 15 years and it is increased by one fold, it could become 30 years."



RESPONSE TO ÖZGÜR ÖZEL'S CRITICISMS



Minister Tunç also reacted to CHP Chairman Özgür Özel, stating, "A political stance is being taken that especially tries to influence the public regarding these cases. This is not correct."

Regarding the process of a terror-free Turkey, Tunç commented on the question, "Will there be a regulation within the process?" saying, "The Parliament will take steps within the framework of the commission report."
