The Ankara 26th Criminal Court of First Instance issued a "lack of jurisdiction" decision in the case regarding the CHP's 38th Ordinary Congress and sent the file to the 5th Criminal Chamber of the Ankara Regional Court of Appeal to resolve the jurisdictional dispute.
After being suspended from his position as the Mayor of Istanbul Metropolitan Municipality (İBB) following his arrest within the scope of a corruption investigation, a case was opened against 12 defendants, including Ekrem İmamoğlu. The Ankara 26th Criminal Court of First Instance decided to send the file to the heavy penal court by ruling a "lack of jurisdiction."
The court stated that it was necessary to evaluate whether the actions of the defendants fell within the scope of the crime of "bribery," and also ruled that since one of the defendants, Erkan Aydın, had been elected as a member of parliament three times before the dates of the alleged crimes, the crimes claimed to have been committed during the period when the deputies were in office fell under the jurisdiction of the heavy penal court according to the relevant law.
NEW "LACK OF JURISDICTION" DECISION
The Ankara 26th Criminal Court of First Instance, which also rejected the objection of the defendants' lawyers regarding the case being heard in the criminal court of first instance, decided that there was no need to correct the decision and sent the file to the on-duty Ankara 3rd Heavy Penal Court for evaluation.
The Ankara 3rd Heavy Penal Court examined the file and ruled that the case should be heard in the Ankara 26th Criminal Court of First Instance.
The Ankara 26th Criminal Court of First Instance again issued a "lack of jurisdiction" decision and sent the file to the 5th Criminal Chamber of the Ankara Regional Court of Justice to resolve the jurisdictional dispute.
FROM THE INDICTMENT
In the indictment prepared by the Ankara Chief Public Prosecutor's Office, it is requested that Ekrem İmamoğlu, who was suspended from his position as İBB Mayor following his arrest within the scope of the corruption investigation, along with Baki Aydöner, Cemil Tugay, Erkan Aydın, Hüseyin Yaşar, Mehmet Kılınçarslan, Metin Güzelkaya, Nihat Yeşiltaş, Özgen Nama, Özgür Çelik, Rıza Akpolat, and Serhat Can Eş, be sentenced to imprisonment of 1 to 3 years for the allegation of "manipulating the vote" as stated in Article 112 of the Political Parties Law.
