While living in the Didim district of Aydın, 65-year-old Hürriyet D. moved to Ankara for treatment due to cancer-related illnesses and filed an eviction lawsuit after the tenant refused to leave the house. His 80-year-old wife, Salih D., moved into a nursing home. The couple withdrew the eviction lawsuit, which had been ongoing for over two years, after their tenants signed a protocol stating that they would vacate the house in April.

The couple Hürriyet D. and Salih D. rented their house in the Çankaya district of Ankara to B.A., who works for a private company, in 2017. The couple, who settled in Didim, experienced various health issues during this time. Hürriyet D. had her uterus removed due to cancer. Hürriyet D. moved into her son’s 1+1 rental apartment, while her husband Salih D., who was also ill, had to move into a nursing home due to the small size of the apartment. Nine months after moving into the nursing home, the tenant B.A. informed the landlord that he would vacate the house. The couple withdrew the eviction lawsuit after the tenant signed a protocol stating that he agreed to pay 200 thousand lira in compensation if he did not vacate the house in April.

Hürriyet D. stated that they decided to move to Ankara for treatment due to their ongoing health problems, but they faced difficulties because their tenant initially did not vacate the house. Hürriyet D. said, "We came to Ankara after my husband was diagnosed with heart failure and dementia. When the tenant did not vacate the house, I moved in with my son, but my husband had to move into a nursing home due to the inadequate physical conditions of my son’s apartment. The tenant said he would not leave unless he bought a house. Of course, we struggled a lot. However, he has now agreed to leave. He informed us that he would vacate the house in April. We made a protocol through our lawyer. If he does not leave, he signed a protocol agreeing to pay 200 thousand lira in compensation. We also withdrew the eviction lawsuit," she said.

'I RECOMMEND APPLYING FOR MEDIATION'

Lawyer Senem Yılmazel stated that the lawsuit process in landlord-tenant disputes takes a very long time, saying, "First of all, I definitely recommend applying for mediation. When mediation is sought, cases are resolved very quickly. We can resolve cases in a very short time, like 2 weeks. Therefore, I recommend that mediation be sought, whether it is mandatory or not. If mediation is not sought and a lawsuit is filed, evidence is very important. For example, when a lawsuit is filed for eviction due to necessity, all information from witnesses, title deed records, and if there is a rental agreement, for example, reports related to illness must be prepared and submitted to the court on the day the lawsuit is filed. And if possible, I recommend that witnesses be prepared and heard at the preliminary hearing. This way, decisions can be made more quickly. However, if evidence is presented incompletely, the court will write a letter, send a request, and then the proceedings will be prolonged. Also, unfortunately, due to the current economic situation, there has been an increase in rental lawsuits, and the burden on the courts is very high. To relieve the courts and to obtain a quick decision, I recommend that all information, documents, and evidence be collected quickly and submitted to the court," she said.
