The codes and explanations related to the reasons for termination were removed from the SGK Registration and Service Statement / Workplace Title List obtained through e-Government. The Council of State ruled that this practice was contrary to the Personal Data Protection Law and the right to work, issuing a cancellation decision.

The SGK Registration and Service Statement / Workplace Title List obtained through e-Government, which includes the reasons for termination, has had the termination codes and explanations removed. With the new regulation, these documents no longer contain information regarding the reasons for leaving the job.

THE COUNCIL OF STATE HAD ISSUED A CANCELLATION DECISION

In its decision dated October 14, 2024, the Council of State examined the code of "violation of moral and good faith rules" found in the records of the Social Security Institution. The Supreme Court determined that this code was based on the employer's unilateral declaration, that claims which had not yet undergone judicial review were recorded in official records, and that this could have negative consequences on individuals' working lives. The Council of State ruled that this practice was contrary to the Personal Data Protection Law and the right to work, issuing a cancellation decision.

CAN BE VIEWED BY THE INDIVIDUAL THEMSELVES

Currently, in the SGK service statement inquiries made through e-Government, termination codes can be viewed by the individual themselves. However, in the SGK Registration and Service Statement / Workplace Title List documents provided to employers, termination codes and reasons for termination are not included.

On the other hand, if the employer requests the employee's notice of termination during the recruitment process, the reason for termination is clearly visible in this document. It is anticipated that the Council of State may also make a decision regarding this document in the future, and that the complete removal of termination codes and explanations under the Personal Data Protection Law may come to the agenda.
