With the announcement published in the Official Gazette, the administrative fines under the Environmental Law have been updated according to the revaluation rate. Sales points that provide plastic bags free of charge in violation of the relevant legislation or use them in a manner that does not comply with the procedures and principles determined by the Ministry will be subject to an administrative fine of 143.75 lira for each square meter of the closed sales area, excluding the storage area.
The "Regulation on Administrative Fines to be Imposed Under the Environmental Law," prepared within the scope of the Environmental Law No. 2872, which regulates administrative fines for polluters, has been published in the Official Gazette. With the regulation, the penalty amounts to be applied under Article 20 of the Environmental Law have been increased in line with the revaluation rate determined as 25.49%.
143.75 LIRA FINE PER SQUARE METER
According to the regulation, sales points that provide plastic bags free of charge in violation of the relevant legislation or that are found to use them in a manner not in accordance with the procedures and principles determined by the Ministry will be subject to an administrative fine of 143.75 lira for each square meter of the closed sales area, excluding the storage area. For those selling in electronic environments, it was stated that the penalty amount could rise from 26,065 lira to 260,701 lira.
130,348 LIRA FINE FOR PRODUCING NON-COMPLIANT BAGS
Additionally, a fine of 130,348 lira will be imposed on those who produce or supply plastic bags in violation of the procedures and principles determined by the Ministry. If the producer is located outside of Turkey, the same amount of administrative fine will be applied to the representative and/or importer authorized by the producer. The penalty for those who do not comply with the established principles regarding the recycling participation fee has been announced as 13,032 lira.
