Work on the 12th Judicial Package, which includes comprehensive regulations for the justice system, continues. The package features important topics such as the alimony system, divorce processes, and expediting trials.
5-YEAR MINIMUM ALIMONY PERIOD ON THE AGENDA
According to NTV’s report, it is planned to end the indefinite alimony practice. Under the regulation, a 5-year minimum period is proposed for alimony. For long-term marriages, granting judges discretion over the alimony duration is being considered.
HALF THE MARRIAGE DURATION MAY BE CRITERION FOR LONG MARRIAGES
Within the new regulation framework, the alimony period for long-term marriages may be determined based on half the marriage duration. For example, in a marriage lasting 20 years, alimony could be awarded for up to 10 years.
NEW DIVORCE CRITERION: SEPARATE LIVING
The package also includes a notable change regarding divorce cases. Accordingly, separate living of married couples will be accepted as grounds for divorce. Sources indicate that this regulation will create a new legal framework for divorce cases.
HEARING INTERVALS TO BE LIMITED
To expedite judicial processes, limits will be imposed on hearing intervals. According to the regulation, the time between hearings cannot exceed 3 months. If this period is exceeded, judges must provide reasonable justification. Additionally, restrictions on judges’ use of expert witnesses are planned. Under the new regulation, judges will not be able to consult expert witnesses to determine legal matters.
REGULATIONS FOR DAYTIME PROGRAMS
The package also includes regulations for the media. A new framework is being prepared for daytime television programs. It is stated that efforts are ongoing to supervise trial-like content appearing in such programs.
NEW REGULATION FOR HOBBY GARDENS
A new regulation is also being prepared regarding illegal structures on agricultural lands. According to information, the study, conducted under the directive of President Recep Tayyip Erdoğan, notes that there are over 100,000 hobby garden-related cases across the country.
EXPECTED TO REACH PARLIAMENT AGENDA
After the completion of the regulations in the 12th Judicial Package, which concern broad segments of society, it is expected to be brought to the agenda of the Grand National Assembly of Turkey.
