In the pool where a child died 3 years ago in Manisa, 5-year-old Halil Umut Kocakaya lost his life by drowning this time. During the investigation, it was revealed that the pool was unlicensed, and the responsible manager was arrested, while the owner of the facility disappeared. Meanwhile, in the incident captured on security cameras, it was observed that Halil Karakaya's brother, unaware of everything, was trying to play with his motionless body after drowning.

CHILD DROWNS IN THE POOL Nurgül Kocakaya (39), who lives in Şehzadeler district of Manisa, took her children Halil Umut Kocakaya and Onur Kocakaya (4) to the pool in Karaağaçlı Neighborhood on August 16. While Nurgül Kocakaya was paying the bill around 14:00, her son Halil Umut Kocakaya disappeared under the bridge in the adult pool. When Nurgül Kocakaya returned to the pool and saw her son Onur, she started looking for her other son Halil whom she couldn't see. While Nurgül Kocakaya was searching for her son, Halil Kocakaya struggled for 2 minutes under the bridge. After a while, the motionless body of the child surfaced.
UNAWARE, HE PLAYED WITH HIS LIFELESS BROTHER While Halil's motionless body was being dragged to the children's pool with the current, Onur, unaware of what was happening, tried to play with his brother. Neither the swimmers nor the pool staff noticed Halil, who remained motionless on the water for about 3 minutes. After someone in the pool called out, the lifeguard approached and pulled the child's motionless body out of the water. Those moments were captured by the pool cameras. After the first intervention in the pool, Halil, who was taken to Manisa City Hospital, could not be saved.
RESPONSIBLE DIRECTOR ARRESTED, OPERATOR BEING SOUGHT Selçuk Kuş, the director responsible for the facility, and S.Ö., the owner of the facility, who were taken into custody after the incident, were released under judicial control. Selçuk Kuş, the facility manager, was arrested again on August 23 after the objection of the prosecutor's office. While the search for S.Ö., who has an arrest warrant, continues, the pool, which was determined to be unlicensed, was sealed.
NOT SEALED AFTER THE FIRST INCIDENT Meanwhile, it was learned that the pool where Yusuf Asaf Tiktaş (8) drowned and lost his life on July 7, 2021, was not sealed at that time. It was stated that the judicial process regarding Tiktaş's death continues in the appellate court. While the pain of Nurgül Kocakaya, who lost her son, is still fresh, the family's lawyer Haşim Çelik made a statement about the incident. Lawyer Çelik said, "There is a tragic death that occurred on August 16 in Karaağaçlı Neighborhood of Şehzadeler district in Manisa. Halil, the son of Nurgül, died while swimming in the pool of this facility. We have determined that this death occurred with a chain of negligence from start to finish."
"THE FACILITY DOES NOT HAVE A LICENSE" Lawyer Çelik stated that there were negligence in the incident and said the following: "It has been observed that the commercial swimming pool where the incident occurred does not have a license. It has been determined that the lifeguard claimed to be working at the workplace does not have a lifeguard training certificate and works without insurance. It has been determined that there are no employees with first aid certificates at the workplace. It has been determined that there is no additional physical measure in the adult pool to prevent possible falls or conscious or unconscious entry of children. It has not been proven that the person claiming to be the responsible director has received chemistry or health education and is at least a high school graduate.
Halil Umut Kocakaya "THERE ARE NO FIRST AID SUPPLIES EITHER" It has also been determined that there are no materials such as ropes, floating buoys, or lifebuoys specific to lifesaving in the adult swimming pool and that there are no first aid supplies near the pool. The employer neglected the obligation to have a first aid personnel, thus the drowning child was deprived of the correct first aid application during the incident. The child was intervened 7 minutes after drowning. Although the suspects did not know, they tried to perform first aid, so it is clear that they were heavily negligent and caused the death.
Despite the mentioned deficiencies by the suspects, while the employees of the facility were trying to perform CPR on the child, they made statements blaming the mother, and an attempt was made to put psychological pressure on the family of the deceased at this stage."
Lawyer Çelik, stating that the municipality also has gross service negligence and that such an incident would not have occurred if they had fulfilled their duties properly, continued his words as follows: "There is a tragic death that occurred on July 7, 2021. Yusuf Asaf Tiktaş, 8 years old, also drowned and lost his life in the pool operated by the suspects. In our research, it was determined that the facility had previously caused the death of another child in a similar accident in 2021 and was operated without a license at that time.
"THE MUNICIPALITY IS ALSO GROSSLY NEGLIGENT" Considering how it was ensured that this facility was operated without a license from 2021 until now, it is seen that the municipality officials, who have gross service negligence, are also responsible for causing the death of another child. Because if they had performed their administrative service properly, the facility would be closed. Thus, these accidents would not have occurred. We look at the incident from this perspective.
"IF THEY HAD CLOSED, THIS DEATH WOULD NOT HAVE HAPPENED" Afterwards, if it had already been a licensed place as required by our law, everything would have been in order because this place would be subject to a license, and this death incident would not have occurred.We demand that the defendants be punished not for causing death by negligence, but for the possible intent evaluated in the law for such businesses. In this way, our request will be for their penalties to be imposed at the upper limit in order to put an end to the suffering of future victims. "
