The Istanbul 9th Administrative Court, in the case filed for the annulment of the suspension of Esenyurt Mayor Ahmet Özer and the appointment of a trustee to the municipality, concluded that the relevant article of the Municipal Law is unconstitutional and submitted a request for annulment to the Constitutional Court.
The Istanbul 9th Administrative Court applied to the Constitutional Court for the annulment of the appointment of a trustee in place of Esenyurt Mayor Ahmet Özer.
On October 30, 2024, the Istanbul Administrative Court made a striking decision regarding Esenyurt Mayor Ahmet Özer, who was arrested as part of the 'City Reconciliation' investigation and replaced by a trustee.
APPLICATION FOR THE CANCELLATION OF THE TRUSTEE
The court applied to the Constitutional Court for annulment on the grounds that the regulation allowing the appointment of trustees in place of mayors who are under investigation for terrorism offenses, added to the Municipal Law during the state of emergency, is unconstitutional.
WHAT HAD HAPPENED?
Esenyurt Mayor Ahmet Özer was arrested last October for the crime of "being a member of the armed terrorist organization PKK/KCK." After his arrest, Özer was suspended from his duties, and a trustee was appointed in his place.
Özer, who faces up to 15 years in prison, recently appeared before a judge, and the court decided to continue his detention.
