UK Labour Party MP Jess Asato has filed a lawsuit against Elon Musk's company xAI, alleging that fake photographs of her in a bikini were created using the artificial intelligence program Grok. The case, brought before the High Court, is seen as one of the first high-profile lawsuits to test the legal liability of AI companies for the design of their systems.

UK Labour Party MP Jess Asato has filed a lawsuit against Elon Musk's xAI company, on the grounds that fake bikini photos of her were created using X's AI program Grok.

“XAI MUST ANSWER FOR THIS”

MP Asato announced in a statement on her US-based X social media platform account that she has filed a lawsuit in the High Court against Elon Musk's AI company xAI.

Asato stated, “I am just one of thousands of women and even children who have been victims of abusive and sexualized AI deepfakes. This should never have happened. xAI must be held accountable for this.”

Labour MP Asato said in a statement in January that she believed the creation of fake and sexualized images of her using AI violated her personal privacy and that she was greatly disturbed by it.

“IF THERE IS A WRONG, THE LAW MUST PROVIDE A REMEDY”

Ravi Naik, a lawyer from the law firm AWO representing Asato, said the case is one of the first to test the responsibility arising from the design of AI systems.

Naik stated, “If there is a wrong, the law must provide a remedy, and that applies to AI just as much as anything else.”

Naik, who argued that the images in question emerged due to the design choices of xAI engineers, said, “We aim to make it clear that safety cannot be an afterthought.”

The lawsuit is considered one of the first high-profile cases to test the limits of legal liability of AI companies arising from their system designs.

CRITICISM OF GROK

Grok faced intense criticism earlier this year after it was revealed that it could be used to create sexualized fake images of real people.

Following the backlash, xAI announced that it would not allow users to create sexualized images of real people.

In the UK, it was later made illegal to create or request non-consensual, AI-generated fake images of adults.
