In Istanbul, Fatma Zehra Kınık Demir, the daughter of former Red Crescent President Kerem Kınık, who is being tried without detention in connection with the traffic accident that resulted in the death of 17-year-old Batın Barlasçeki and injuries to two others, appeared before the judge again following the appellate court's decision to overturn the previous ruling. In her statement during the hearing, Demir said, "After completing all my checks, I entered the road in a controlled manner as the minibus gave me way. I collided with the motorcycle that was coming at high speed in the middle of the road. The accident occurred in this way."

On July 9, in the Beykoz district of Istanbul, Fatma Zehra Kınık Demir, the daughter of former Red Crescent President Kerem Kınık, was sentenced to 4 years and 2 months in prison for causing the death of 17-year-old Batın Barlasçeki and injuring multiple people in an accident after hitting a motorcycle while driving. Kınık's driver's license was also revoked for 2 years.

DECISION OVERTURNED ON APPEAL

The Istanbul Regional Court of Appeals, 19th Criminal Chamber, overturned the decision made by the local court, Anadolu 8th High Criminal Court. The Criminal Chamber stated that Kınık, who was convicted of causing death and injury by negligence, should be punished for 'causing death by negligence' due to the withdrawal of complaints by the victims. The appellate court sent the case back to Anadolu 8th High Criminal Court after the injured parties withdrew their complaints.

RETURNED TO COURT: I HIT THE MOTORCYCLE DUE TO ITS HIGH SPEED

Kınık appeared before the judge again following the appellate court's decision. The hearing at Anadolu 8th High Criminal Court was attended by the defendant Fatma Zehra Kınık Demir and the lawyers of the parties.

Kınık stated in her testimony during the hearing, "I pray for mercy for the deceased and patience for their family. I share their sorrow. After completing all my checks, I cautiously entered the road as the minibus gave way to me. I hit the motorcycle due to its high speed coming quickly in the middle of the road. The accident occurred this way," she said.

PROSECUTOR PRESENTED HIS OPINION

In the retrial, the public prosecutor presented his opinion on the merits, stating that Muammer Kızıl, one of the complainants, withdrew his complaint during the investigation phase, while the injured complainant Öztürk withdrew his complaint during the appeal phase, requesting the defendant to be punished for "causing death by negligence."

THE NEXT HEARING IS ON DECEMBER 18

The defendant's lawyers requested time from the court to respond to the opinion. The court panel postponed the hearing to December 18.

FROM THE INDICTMENT

In the indictment prepared by the Anadolu Chief Public Prosecutor's Office, it was stated that on the date of the incident, the defendant Demir hit Öztürk's motorcycle with the vehicle she was driving, resulting in the death of Batın Barlasçeki and injuries to Muammer Kızıl and Yavuz Selim Öztürk due to her negligent actions. The defendant was requested to be sentenced to imprisonment of 2 to 15 years for the crime of 'causing death and injury by negligence.' After the acceptance of the indictment, an additional indictment prepared by the prosecutor regarding Öztürk, who was under 18 years old and found to have responsibility in the incident, was merged with the main case.
