A 17-year-old girl named Beyza Ö., who killed the greengrocer Halil İbrahim Mercan by stabbing him while he was sleeping in a chair, was sentenced to 20 years in prison. The ruling stated that there was no evidence to support Beyza Ö.'s claims of being "harassed and threatened."
In Milas, the penalty for 17-year-old Beyza, who was accused of killing the greengrocer Halil İbrahim Mercan, found dead in his chair, has been determined.
CAUGHT WITH THE MURDER WEAPON
The incident occurred on February 2, 2025, in Eski Demirciler Street, Hisarbaşı Hocabedrettin Neighborhood. After a report was made about a person found motionless in a chair in the early morning, teams were dispatched to the scene. Upon examination, it was determined that the person had been stabbed to death. Following a criminal investigation and security camera footage, B.Ö. was identified as the murder suspect and was caught at home with the knife allegedly used in the incident.
STABBED AND FLED
The Milas Heavy Penal Court, in the decision of the trial conducted as a juvenile court, stated that the prosecution claimed the victim was sleeping on the street at the time of the incident and that the defendant approached him with a knife and stabbed him 7-8 times in the shoulder, head, and chest areas. It was reported that the defendant fled after the incident, the knife used was handed over to the police by the defendant's father, and the defendant was caught at his mother's house.
EVIDENCE POINTED TO THE YOUNG GIRL
In the defense of the defendant, there was no evidence to support the claim of "harassment and threats," and according to the report from Manisa Mental Health and Diseases Hospital, it was determined that the defendant had full criminal capacity. The forensic examination revealed that the swabs on the knife matched the defendant's DNA, and the victim's death was caused by internal organ and vessel cuts due to sharp-edged weapon injuries, as established by the report and evidence.
The prosecution requested that the defendant be punished under Article 82/1-e of the Turkish Penal Code for the crime of "Deliberately Killing a Person Unable to Defend Themselves Physically or Mentally," based on these reasons.
20 YEARS IN PRISON
In the decision hearing, the court acquitted the defendant of the crime of "carrying a prohibited knife" under Law No. 6136, sentenced her to aggravated life imprisonment for the qualified intentional murder of the victim, and due to the defendant being 17 years old at the time of the crime, reduced the sentence to 24 years under Article 31/3 of the Turkish Penal Code, and further reduced it to 20 years with a discretionary discount under Article 62/1 of the Turkish Penal Code. Considering the amount of the sentence, it was decided that there was no need for the postponement or judicial control provisions regarding the announcement of the verdict, and the continuation of the detention was ordered.
APPEAL OPTION LEFT OPEN
After reading the decision, the court informed the parties that they could file an appeal within two weeks. It was stated that the appeal would suspend the finalization of the verdict. The process regarding the incident will be shaped according to whether the case will be taken to a higher court.
