The court's reasoning regarding the 10.5-year prison sentence given to police officer Süleyman Ay in İzmir's Karabağlar district and the acquittal of the victim Büşra Karademir has been announced. In the reasoned decision, it was emphasized that the defendant Ay's defenses were inconsistent and lacked credibility, while Karademir's statements were found to be consistent with witness testimonies and material evidence.
In the Karabağlar district of İzmir, the justification for the 10.5-year prison sentence given to police officer Süleyman Ay (50), who is accused of sexually assaulting Büşra Karademir (32) after dropping her off at her home following her statement, and the acquittal decision for Karademir, who shot Ay with a gun, has been announced. In the reasoned decision, it was stated that Süleyman Ay's defenses were found to be unconvincing, and Karademir's statements, which were confirmed by witness testimonies and material evidence, were given precedence.
The incident occurred on January 31, 2024, around 11:00 PM in an apartment on 6002 Street in the Uzundere neighborhood. Büşra Karademir, who has four children from her first marriage and is in a second marriage with Cenk Karademir, with whom she has severe marital discord and whose divorce case will be heard on February 2, allegedly pressed the 'KADES' application to request help when her husband came to their home. The police teams that arrived at the house took Büşra Karademir and brought her to the Family Violence Bureau of the Karabağlar Police Department. After her statement, it is alleged that police officer Süleyman Ay sexually assaulted Karademir, who was taken home by the police vehicle. Karademir shot Ay with a gun.
"BEAUTIFUL WOMEN DON'T COME HERE"
As part of the investigation, Büşra Karademir recounted the events in her statement. According to Karademir's claim, police officer Süleyman Ay at the police station gave her candy, saying, "Beautiful women don't come here," and then touched her cheek. After her statement was completed, Karademir got into the police vehicle. She was taken home by Süleyman Ay and another police officer, S.M., who was driving the vehicle. After getting out of the car, Ay entered Karademir's house, saying, "Let me check the door." It is alleged that police officer Ay, after taking off his gun and jacket and leaving them in front of the mirror in the house, cornered Karademir and sexually assaulted her. Karademir tried to defend herself and fired the gun she grabbed from the mirror at Ay. Police officer Ay was injured in the abdomen. Karademir, who went out to the balcony, shouted for help, saying, "The police attacked me. Help. I shot the police." Police officer Ay was taken to Dokuz Eylul University Hospital by ambulance and was discharged after treatment. After the incident, Büşra Karademir was arrested at the courthouse she was sent to. Police officer Ay was suspended. Büşra Karademir was later released to be tried without detention.
DECISION ANNOUNCED
After the completion of the investigation, the indictment prepared stated that Süleyman Ay was charged with 'Violation of the right to housing' for 1 to 3 years, 'Depriving a person of their freedom for sexual purposes using force, threat, or deception' for 3 to 10.5 years, 'Attempted qualified sexual assault' for 7.5 to 15 years, 'Repeated sexual harassment' for 6 months to 3 years, and 'Sexual assault by harassment' for 2 to 5 years, totaling a request for imprisonment of 14 to 36.5 years.
Büşra Karademir was charged with 'Attempted murder' for 9 to 15 years and 'Purchasing, carrying, or possessing unlicensed firearms and ammunition' for 1 to 3 years, totaling a request for imprisonment of 10 to 18 years. Ay, who was tried at the İzmir 1st High Criminal Court, claimed that he was falsely accused. In the trial held last February, a decision was made. The defendant Ay was sentenced to 6 years in prison for 'Sexual assault,' and since he was a public official, his sentence was increased to 9 years. Süleyman Ay was also sentenced to 1.5 years in prison for 'Violation of the right to housing,' resulting in a total of 10.5 years in prison without any reductions. The court ruled that Büşra Karademir committed the crimes attributed to her in order to escape from the attack against her and decided to acquit her.
"SEXUAL ASSAULT CRIME WAS ESTABLISHED"
The court explained the reasoning for the decision. It emphasized that Ay committed the crime of sexual assault by entering the victim's home using the influence provided by his position during his duty. The decision highlighted that the actions of the defendant, which were of a sexual assault nature, began while they were at the police station and continued at the moment he dropped her off at her home, and there was no time interval that would require accepting a physical interruption between the actions. It was also stated in the decision that the elements of the crime of depriving the victim of their freedom were not present. The court also found that the defendant entered Karademir's home without permission at night.

The court panel emphasized that Karademir, who was sexually assaulted in her home, realized that she could not escape and shot police officer Ay with her gun, which was proportional to the assault she faced. The decision stated that the conditions for legitimate defense regarding the attack and defense were present together. It was emphasized that since all the conditions for legitimate defense were met, Karademir was acquitted of the charge of 'Attempted murder.'
Although Ay claimed that Büşra suddenly fired the gun that belonged to him, this defense was not taken into account. It was noted that although Ay claimed he did not take off his coat inside the house, the absence of a bullet hole in the coat contradicted this statement. In light of all this evidence, the court found Ay's defenses unconvincing and upheld the statements of the defendant Büşra Karademir, which were confirmed by witness testimonies and material evidence.
On the other hand, it was learned that the defendant Ay's lawyer, Emrullah Aksakal, appealed the decision and that the case has been taken to the appellate court.
