The case of the defendant who called his wife via video in Izmir and threatened her by holding a knife to their children's throats was concluded after a jurisdictional dispute between courts. The defendant was sentenced to 2 years and 3 months in prison for 'intentionally injuring a child' and 6 years in prison for 'armed threatening against a spouse.' The court did not apply any reduction to the sentence. The defendant had also received a prison sentence of 4 years and 11 months in a separate case.

In İzmir, 31-year-old Şiyar Alpaslan, who video-called his 27-year-old wife Fatma C., who was in the process of divorcing, and threatened her by holding a knife to their children’s throats, was sentenced to a total of 8 years and 3 months in prison.

HE VIDEO-CALLED AND HELD A KNIFE TO THE CHILDREN’S THROATS

Fatma C., who decided to divorce due to severe marital discord, left her 2 children with her husband Şiyar Alpaslan and went to Burdur. According to the allegation, on November 18, 2024, Alpaslan video-called Fatma C. and held a knife to the throats of their 7- and 3-year-old children who were staying with him, and threatened his wife.

When Fatma C. went to the police and filed a complaint, teams detained Alpaslan in the Karabağlar district. While the children were taken into state protection, Alpaslan was arrested after his procedures. The children were handed over to their mother after the examination.

JURISDICTION DISPUTE BETWEEN COURTS

In the prepared indictment, the prosecutor requested up to a total of 6.5 years in prison for Alpaslan on charges of “intentional injury” and “threatening with a weapon.” At the hearing at İzmir 29th Criminal Court of First Instance, which accepted the indictment, the defendant was released, but he was re-arrested upon the objection of the İzmir Chief Public Prosecutor's Office.

İzmir 29th Criminal Court of First Instance ruled that the act was “attempted intentional homicide,” issued a lack of jurisdiction decision, and sent the file to the high criminal court. İzmir 18th High Criminal Court, however, concluded that the act constituted the elements of the crime of “threat” and decided that the case should be heard in the criminal court of first instance.

Upon the resulting jurisdictional dispute, İzmir Regional Court of Appeal 23rd Criminal Chamber ruled that the defendant should be tried on the charge of “attempted intentional homicide,” and the file was sent to İzmir 18th High Criminal Court. During this process, the couple divorced.

RELEASED, THEN RE-ARRESTED

At the hearing on December 16, 2025, it was decided to release Alpaslan under judicial control conditions in the form of house arrest. Upon the objection of the İzmir Chief Public Prosecutor's Office and lawyers, the İzmir 19th High Criminal Court, which examined the file, decided that the judicial control measure would be insufficient in terms of the victims’ safety of life. With the acceptance of the objection, Alpaslan was re-arrested.

HE WAS ALSO SENTENCED FOR THREATENING FROM PRISON

On the grounds that the defendant, while in prison, threatened Fatma C. during a phone call with his mother Ş.K., a case was filed against mother and son at İzmir 53rd Criminal Court of First Instance on the charge of “threat.” In this case, Alpaslan was sentenced to 4 years and 11 months in prison, and his mother Ş.K. to 1 year and 6 months.

HE HELD A KNIFE TO THEIR THROATS, SAID “I CANNOT SEE MY CHILDREN”

At the hearing held at İzmir 18th High Criminal Court, the defendant attended via the Audio and Visual Information System (SEGBİS), while the lawyers attended from the courtroom. The public prosecutor requested that Alpaslan be punished for the crimes of “simple injury against his child” and “threat against spouse.”

Alpaslan, who requested his acquittal, said in his defense: “We endured difficulties together with my children. Fatma is the one who dragged me here. I was both mother and father to my children. The other side speaks without knowing what I have suffered. I have not seen my children for 2 years.”

8 YEARS 3 MONTHS PRISON SENTENCE

The court panel sentenced the defendant Alpaslan to a total of 8 years and 3 months in prison: 2 years and 3 months for the crime of “intentional injury against a child” and 6 years for the crime of “armed threat against spouse.” The court did not apply any reduction to the defendant’s sentence.
