The lawyer of Nevzat Bahtiyar, one of the defendants in the Narin Güran case, Ali Eryılmaz, has resigned from his position. Eryılmaz stated, "I am leaving due to a moral responsibility that I can no longer bear. A case has been filed against 4 people at the Diyarbakır 8th High Criminal Court regarding Narin Güran's death.
4 PEOPLE HAD BEEN SENTENCED Salim Güran, Narin's uncle, who had DNA and hair samples belonging to Narin in his vehicle, along with his mother Yüksel Güran and his brother Enes Güran, as well as their neighbor Nevzat Bahtiyar, who was identified by security cameras as having transported Narin's lifeless body in a red vehicle and claimed after being detained that he did not kill Narin but only hid her by carrying her to the stream, were sought to be sentenced to aggravated life imprisonment for the crime of 'intentional murder of a child in complicity.' In the second hearing of the case held on December 28, 2024, Salim Güran, Enes Güran, and Yüksel Güran were sentenced to aggravated life imprisonment for 'intentional murder of a child in complicity,' while Nevzat Bahtiyar was sentenced to 4 years and 6 months in prison for 'destroying, hiding, or altering evidence.'
APPEAL CONFIRMED THE SENTENCES BY MAJORITY VOTE, FILE AT THE COURT OF CASSATION The lawyers of the detained defendants, along with the lawyers of father Arif Güran, and the appeal petitions of the Ministry of Family and Social Services and the Diyarbakır Bar Association were sent by the Diyarbakır 8th High Criminal Court to the 1st Criminal Chamber of the Diyarbakır Regional Court of Justice. In its decision on May 26, the 1st Criminal Chamber of the Regional Court of Justice confirmed the prison sentences given to the 4 defendants by majority vote, but the presiding judge noted a dissenting opinion, stating that the camera recordings, base reports, DNA findings, PSA, and hair samples were inadequately examined. The president emphasized that the acceptance that the mother, brother, and uncle committed the murder together in a short time was contrary to the ordinary course of life, and that the actions of Nevzat Bahtiyar needed to be clarified through detailed video analysis, stressing that the evidence was scientifically evaluated as insufficient. The Chief Public Prosecutor's Office of the Court of Cassation, in its prepared opinion, stated that the life sentences given to defendants Salim, Yüksel, and Enes Güran and the sentence given to Nevzat Bahtiyar were in accordance with the law and requested their confirmation, and the file was sent to the 1st Criminal Chamber of the Court of Cassation.
'THE FILE OF 'PROTECTING THE GUILTY' WAS DISMISSED The 7th Criminal Chamber of the Diyarbakır Regional Court of Justice dismissed the conviction decisions against 15 defendants in the 'protecting the guilty' case related to the murder of Narin Güran, ruling that this file could not be finalized before the main case, which is at the Court of Cassation, is concluded. It ruled that the file should be treated as a pending issue.
WITHDREW FROM REPRESENTATION Defendant Nevzat Bahtiyar's lawyer, Ali Eryılmaz, made a statement on his social media account. In his post, he announced that he had withdrawn from representing Bahtiyar, stating, "Today, I am withdrawing not only from a representation duty but from a heavy burden that has tested my faith and professional honor. I can no longer carry the moral responsibility of defending Nevzat Bahtiyar, whom I took on as a defense in the Narin Güran case during the most challenging moments. Behind this decision lies the fact that a colleague with whom we should have walked shoulder to shoulder in a case has refrained from defending the truth after the case was concluded. While I fight alone in the ruthless corridors of social media, the silence of those who should be by my side in the face of lynch campaigns against me, and the friendships he has formed with those who organized that lynch, have left a deep wound in my heart," he expressed.
"THE LAST DROP THAT OVERFLOWED THE CUP WAS THE VOICE RECORDING SAYING 'NEVZAT KILLED NARIN'" Eryılmaz continued his statement: "However, the last drop that overflowed the cup was the existence of a voice recording, allegedly belonging to that lawyer, stating 'Nevzat killed Narin.' Trust, which is the foundation of a defense, has been dynamited by our own companion. The saddest part is that my client and his family, who know all these events, have fallen into a deep silence in the face of this dishonorable betrayal, leaving me alone. If even the shadow of those who should be by your side does not fall upon you, and if you are expected to stand alongside a lawyer who has lost faith, and most importantly, if doubts about the innocence of the person you are defending are expressed by your own partner, one cannot remain in that battle any longer. But in the Narin case, based on the information I have obtained through the work I have done and will do for Narin, I will continue to report and disturb the Diyarbakır Chief Public Prosecutor's Office for the prosecution of those who are outside the trials, not included in the trials, or involved in other crimes. This is not a surrender but a requirement of my respect for the truth and my professional and personal honor. Sincerely."
