DECISION IN THE HRANT DINK CASE The retrial continued in the case where public officials were tried for the murder of Agos Newspaper's Editor-in-Chief Hrant Dink, which the Court of Cassation partially overturned for 15 defendants. During the hearing held at the Istanbul 14th High Criminal Court, detained defendant Muharrem Demirkale was present. LIFE IMPRISONMENT FOR 9 DEFENDANTS After hearing the defenses, the court announced its decision, sentencing Bekir Yokuş, who was serving as a specialist sergeant at the time of the incident, Gazi Günay, who was serving as a senior sergeant, Okan Şimşek, who was serving as a sergeant, Ali Öz, who was serving as a colonel, Mehmet Ayhan, who was serving as a police officer, Onur Karakaya, who was serving as a police officer, Osman Gülbel, who was serving as a deputy branch manager, and Hasan Durmuşoğlu, who was serving as a deputy director, to life imprisonment for the crime of 'violating the constitution'. Additionally, life imprisonment was given to Captain Muharrem Demirkale for the crime of 'premeditated murder'. Furthermore, the case against defendant Demirkale for the crime of 'violating the constitution' was dismissed.
The court sentenced defendant Bekir Yokuş to 10 years in prison for 'aiding and abetting premeditated murder', defendant Gazi Günay to 25 years in prison for 'premeditated murder', defendant Okan Şimşek to 25 years in prison for 'murder', defendant Ali Öz to 25 years in prison for the same crime, defendant Mehmet Ayhan to 12 years and 6 months in prison for the same crime, defendant Onur Karakaya to 12 years and 6 months in prison for the same crime, defendant Osman Gülbel to 16 years and 8 months in prison for the same crime, and defendant Hasan Durmuşoğlu to 12 years and 6 months in prison for the same crime.
The panel, which ruled to dismiss the case against Yavuz Karakaya, who was serving as a senior sergeant at the time of the incident for the crime of 'violating the constitution', sentenced him to 12 years and 6 months in prison for 'aiding and abetting premeditated murder'.
DETENTION ORDER FOR 3 DEFENDANTS The court sentenced defendant Veysal Şahin, who was serving as a specialist sergeant at the time of the incident, to 15 years in prison for 'intentional killing by negligent behavior' and ruled for the detention of defendants Onur Karakaya, Mehmet Ayhan, and Bekir Yokuş. Some defendants were acquitted of other charges against them, and their cases were dismissed.
3 DEFENDANTS ACQUITTED On the other hand, the court acquitted defendants Volkan Şahin, Mehmet Ali Özkılınç, and Şükrü Yıldız of the charges against them due to lack of sufficient and conclusive evidence, while it was decided to separate the case of the fugitive defendant Faruk Sarı, who had an arrest warrant against him.
FROM THE OPINION In the announced opinion, it was requested that defendant Veysal Şahin, who was serving as a specialist sergeant in 2007, Colonel Ali Öz, Senior Sergeant Gazi Günay, Deputy Director Hasan Durmuşoğlu, Police Officer Mehmet Ayhan, Sergeant Okan Şimşek, Police Officer Onur Karakaya, and Deputy Branch Manager Osman Gülbel be sentenced to aggravated life imprisonment for the crimes of 'premeditated murder' and 'violating the constitution'.
In the opinion, it was requested that Bekir Yokuş, who was serving as a specialist sergeant in 2007, be sentenced to aggravated life imprisonment for 'aiding and abetting premeditated murder' and for 'violating the constitution', a prison sentence of 22 years and 6 months to 30 years be requested. It was also requested that Captain Muharrem Demirkale be sentenced to aggravated life imprisonment for 'premeditated murder' and that the case for 'violating the constitution' be dismissed. In the announced opinion, it was requested that Senior Sergeant Yavuz Karakaya be sentenced to 22 years and 6 months to 30 years in prison for 'aiding and abetting premeditated murder', while it was requested that the case for 'violating the constitution' be dismissed.
