On July 4, 2022, around 12:30 PM, a chilling incident occurred on Hürriyet Street in the Hacı Seyit Ali neighborhood of Seydişehir district in Konya. Osman Yavuz (31), a second-year student in the Civil Engineering Department at Istanbul Technical University, shot and killed his neighbor, jeweler Yusuf Şahin (60), with a gun at his workplace.



2014 LYS DISTRICT FIRST PLACE HOLDER ARRESTED



After the incident, Yavuz, who fled, was apprehended by the police at the house where he was hiding. Osman Yavuz, who was the first in Seydişehir in all score types in the 2014 Undergraduate Placement Exam (LYS) and was accepted into Hacettepe University Faculty of Medicine but dropped out in the third year, was arrested by the court he was brought to after his procedures at the police station.



"I WAS HEARING CONSTANT VOICES IN MY EAR"



Osman Yavuz, whose final hearing was held at the Seydişehir Heavy Penal Court, attended the court via SEGBİS from Dinar Type T Closed and Open Penal Institution where he was detained. In previous hearings, he stated, "On the day of the incident, he started looking at me meaningfully. I felt he was looking at me while entering and exiting the shop. He was telling business people about my illness. He was showing me a gun. I do not have a gun. My father had a gun in the drawer. On the day of the incident, I took my father's gun from the drawer. I was constantly hearing voices in my ear. I was thinking how could this happen, is it possible? His gaze seemed to approach me with a sexual intent. I did not tell anyone that I was disturbed by Yusuf Şahin's gaze. On the day of the incident, I took my father's gun. I entered his shop and shot him," Yavuz said, adding in the last hearing, "I have nothing to say."



FOUND TO BE MENTALLY ILL



During the hearing, a report from the Forensic Medicine Department of Süleyman Demirel University was read. The report stated, "It has been understood that he is a mentally ill person whose ability to perceive the legal meaning and consequences of the act of intentional killing and to direct his behavior regarding this act is significantly reduced, and that there is no need for security measures to be applied in his current state, but he should continue regular psychiatric outpatient controls."



"CONSIDER THE ABILITY TO ACT"



After the reading of the report, Ezgi Kılınç, the lawyer of the deceased Yusuf Şahin's family, stated, "These reports are not binding. They are instructive for the court. The defendant we see is not an ordinary defendant. We request that his ability to act be taken into consideration. This case is not an ordinary intentional killing case. The defendant can speak quite clearly. I claim that the defendant's doctors are being guided while acting. I request that a decision be made considering the moral conviction."



RELEASED DUE TO LACK OF CRIMINAL CAPACITY



The court panel, announcing its decision during the hearing, stated, "Although it is certain that Osman Yavuz committed the crime of intentional killing, it has been understood that the defendant is mentally ill and lacks criminal capacity, therefore there is no need to impose a penalty on the defendant, and the defendant is to be released from prison, and he is to be placed under protection and treatment in high-security health institutions immediately. If the report prepared by the health board indicates that the danger to society has been eliminated or significantly reduced, the defendant may be released by court or judge's decision."
