In Bursa, due to severe incompatibility, a couple who had been living separately for a while saw Orhan S. sending flowers to his wife, Sabriye S., in the morning to make peace. In the afternoon, Orhan S. shot his wife in the leg in front of their children. Sabriye S. did not file a complaint against her husband.
In the Hamidiye neighborhood of Gemlik district in Bursa, in March 2024, Orhan S. (39) shot his wife Sabriye S. (34) in the left leg with a gun in front of their children due to severe marital discord, after living separately for a while. Police and medical teams were dispatched to the scene upon the notification of the surrounding people. After the initial intervention, Sabriye S. was taken to the hospital, while Orhan S. was detained.
UP TO 11 YEARS IN PRISON REQUESTED
After his procedures at the police station, Orhan S. was arrested by the court he was brought to at the courthouse, and a case was opened against him at the Gemlik Criminal Court of First Instance for "Injury", "Violation of Law No. 6136", "Threat against a woman", and "Violation of obligations arising from family law", with a total request for up to 11 years in prison.
NO COMPLAINT FILED
Sabriye S., who attended the first hearing as a complainant, stated that the defendant was her husband of 18 years, saying, "There was discord between us. We were living separately. On the morning of the incident, Orhan sent me flowers to reconcile. I was very happy. Later that same day, he injured me with a gun in front of our children. It's okay. I am not complaining about him. I want him to be released," she said.
"MY WIFE HIT MY HAND AND THE GUN FIRED"
Orhan S. stated in his testimony at the court that he had no intention of injuring his wife, saying, "I wanted to scare Sabriye. We were living separately. She had invited me to breakfast, and I had bought her flowers to reconcile. Then our discord continued. On the day of the incident, when my wife saw the gun in my hand, she hit my hand, and the gun fired," he said.
DEFENSE OF "UNJUST PROVOCATION" FROM THE LAWYER
The defendant's lawyer, Uğur Kösa, stated that his client acted under unjust provocation during the argument with his wife, saying, "My client acted under the influence of the anger and severe distress caused by the unjust act committed against him. For this reason, it should be accepted that my client's act was carried out under unjust provocation," he stated.
RELEASED
While the judge postponed the hearing, he decided to release Orhan S., who had spent 35 days in prison.
