Justice Minister Yılmaz Tunç made noteworthy comments regarding the 10th Judicial Package that passed through the Turkish Grand National Assembly's Justice Commission. Expressing that the Draft Law, prepared in line with the targets in the Turkey Century Judicial Reform Strategy Document, includes changes in many areas concerning both the execution system and social life, Tunç noted that the proposal, which foresees changes in 10 different laws, consists of 30 articles. Tunç also thanked the members of parliament who contributed to the process and used striking expressions regarding the proposal.

"A NEW ERA IN SUPERVISED RELEASE WITH THE 10TH JUDICIAL PACKAGE"

Tunç wrote, "The perception of impunity that is being attempted to be created in our society will be eliminated with the new regulation," and stated, "Even if the sentence of the convicts is less than 2 years, they will be able to be released on supervised release after spending at least 1/10 of the time until the conditional release date in the penal institution. Thus, the deterrent effect of the sentence will be strengthened, and the execution of the sentence will be carried out in a purpose-oriented manner."

"EFFECTIVE FIGHT AGAINST CRIME, REFORMATIVE UNDERSTANDING IN PUNISHMENT"

Tunç's evaluations are as follows: "With the 10th Judicial Package, while an effective fight against crime is ensured, important steps will also be taken for the rehabilitation of the offender. Convicts who are subject to recidivism provisions for the second time will be allowed to be released conditionally to ensure their adaptation to the outside world, to prevent them from committing crimes again through rehabilitation, and to reintegrate them into society. Those who are subject to recidivism provisions for the second time will be able to benefit from conditional release if they serve 3/4 of their fixed prison sentence in good behavior."

"HUMAN-CENTERED APPROACH IN EXECUTION"

With the 10th Judicial Package, the scope of special execution procedures will be expanded. The scope of the execution procedure during weekends or at night will be increased from 1 year 6 months to 3 years for intentionally committed crimes; for crimes committed negligently, except for negligent homicide, it will be increased from 3 years to 5 years. The scope of the execution procedure in the residence will be increased from 1 year to 3 years for women, children, or individuals over 65; from 2 years to 4 years for individuals over 70; and from 4 years to 5 years for individuals over 75. For individuals over 80, it will be possible to decide on the execution of a prison sentence of up to 6 years in their residence.

Except for those sentenced to aggravated life imprisonment, among those sentenced to imprisonment, those who are determined to be unable to sustain their life alone under the conditions of the penal institution due to a serious illness or disability and are assessed not to pose a serious and concrete danger to public safety may have their sentences served at home. Additionally, female convicts who have given birth and have received a prison sentence of 5 years or less will be allowed to serve their sentences at home instead of 3 years.

"REHABILITATION AND EDUCATION-FOCUSED EXECUTION FOR CHILDREN"

With the 10th Judicial Package, changes will be made in the penal execution system for child convicts. The decision for child convicts to be transferred from the closed juvenile penal institution to the juvenile education institution will be made based on the assessment of good behavior. Those convicted of intentional crimes with a total prison sentence of 3 years or less and those convicted of negligent crimes with a total prison sentence of 5 years or less will have their sentences served directly in juvenile education institutions.

"SAFETY IN TRAFFIC IS ESSENTIAL, NO TOLERANCE FOR DISORDER"

With the regulations to be made in the 10th Judicial Package, we will fight more effectively against actions that disrupt traffic order. Cutting off the road in traffic will be regulated as an independent crime. A person who prevents a land transportation vehicle from moving with an unlawful act, stops it while it is in motion, or takes it from one place to another will be punished with imprisonment from 1 year to 3 years. Penalties for those who endanger traffic safety will be increased.

In this context, the lower limit of the prison sentence for those who operate land, sea, air, or railway vehicles in a way that may endanger the life, health, or property of individuals will be increased, and the penalty will be determined as imprisonment from 4 months to 2 years. The lower limit of the prison sentence for those who drive a vehicle while unable to do so safely due to alcohol, drug influence, or other reasons will be raised from 3 months to 6 months, and the penalty will be determined as imprisonment from 6 months to 2 years.

"NO PLACE FOR WEAPONS IN OUR HAPPY DAYS"

We will resolutely continue our fight against those who turn our joyful days, especially weddings, into sadness. With the regulation to be made in the 10th Judicial Package, weapons that can fire sound and gas cartridges, known as "blank-firing," will also be included in the scope of the crime of "deliberately endangering public safety." The penalty for those who fire weapons, including those who can fire sound and gas cartridges in populated areas, or use explosives, will be increased, and the penalty will be determined as imprisonment from 1 year to 5 years. If this crime is committed in places where people gather, such as weddings, engagements, and military send-offs, the penalty will be increased by up to one and a half times.

"STRONGER SANCTIONS AGAINST VIOLENCE AND THREATS"

With the regulations to be made within the scope of the 10th Judicial Package, the prison sentences for intentional injury crimes against bodily integrity will be increased. Prison sentences for intentional injury crimes will be increased by 50%. An effective fight will be ensured against the crime of threat. The lower limit of the penalty for simple threat will be 2 months. In cases where the threat crime is committed with a weapon, by putting the person in a state of unrecognizability, by multiple persons together, or by utilizing the intimidating power created by criminal organizations, the upper limit of the penalty will be increased from 5 years to 7 years. In case of attempted crime, the lower and upper limits of the prison sentence to be given instead of aggravated life imprisonment and life imprisonment will be increased.

"PERSONAL RIGHTS SECURED IN THE DIGITAL DOMAIN"

Regulations are being made in the Law on the Regulation of Publications Made on the Internet and the Fight Against Crimes Committed Through These Publications regarding access blocking and/or content removal within the scope of the 10th Judicial Package.

In online environments, individuals are provided with the means to prevent attacks on their honor and reputation. Individuals who claim that their personal rights have been violated due to the content can apply to the peace criminal court for the removal of the content and/or the blocking of access.

The peace criminal court may decide to remove the content and/or block access within twenty-four hours in cases where the violation can be understood at first glance without the need for a detailed examination; otherwise, the application will be rejected. Decisions made by peace criminal courts can be appealed, and the judge whose decision is being appealed or the authority competent to examine the appeal may listen to the parties if deemed necessary. The aim of all these regulations to be made in digital media is to protect personal rights more effectively in this area as well.

"CLEAR AND PREDICTABLE DISCIPLINARY PROVISIONS IN NOTARIAL SERVICES"

Within the scope of the 10th Judicial Package, the disciplinary provisions in the Notary Law are being reorganized. Disciplinary sanctions will be clearly and explicitly defined within the framework of legal certainty and predictability principles. I sincerely believe that the 10th Judicial Package, which has passed through the TBMM Justice Commission, will also be accepted in the TBMM General Assembly with the strong support of our members of parliament. Under the leadership of our President, Mr. Recep Tayyip Erdoğan, we will continue our efforts with determination, based on the rule of law, with a vision of a justice system that is timely and predictable. We will elevate our citizens' trust in justice to the highest level and make the Century of Turkey the Century of Justice.
