The decision regarding Fatma Zehra Kınık, who was sentenced to 4 years and 2 months in prison for the crime of 'causing the death of one person and injuring multiple people by negligence' in the accident that resulted in the death of 17-year-old motorcyclist Batın Barlasçeki in Beykoz, has been overturned by the appellate court. It was noted that three of the injured parties withdrew their complaints and that Kınık should only be punished for the death of one person.

THE 17-YEAR-OLD YOUNGSTER HAD LOST HIS LIFE

On July 9, 2024, around 1:30 PM, Fatma Zehra Kınık, the daughter of former Kızılay President Kerem Kınık, was driving a car with the license plate 34 FKJ 390 in the Kavacık neighborhood. While she was turning from Baki Street to Fatih Sultan Mehmet Avenue, she collided with a motorcycle driven by Yavuz Selim Öztürk, who was riding without a helmet and had a passenger behind him. As a result of the collision, both the driver and the passenger, Batın Barlasçeki, were seriously injured. Despite all the interventions at the hospital, Barlasçeki lost his life.

RECEIVED 4 YEARS AND 2 MONTHS PRISON SENTENCE

A lawsuit was filed against Fatma Zehra Kınık with a request for up to 15 years in prison. In the verdict hearing held on May 26, the Anadolu 8th High Criminal Court sentenced Kınık to 4 years and 2 months in prison for the crime of 'causing the death of one person and injuring multiple people by negligence' and ruled that her driver's license be revoked for 2 years. While the case was in the appeal stage, Batın Barlasçeki's father and Yavuz Selim Öztürk, who was injured in the incident, withdrew their complaints.

REGIONAL COURT OF APPEALS OVERTURNED THE DECISION

The Istanbul Regional Court of Appeals 19th Criminal Chamber, which examined the case, noted that I.E.Ü., who was injured in the incident, did not file a complaint during the investigation phase, and M.Ü. did not file a complaint during the prosecution phase. It was stated that Yavuz Selim Öztürk, who was injured in the incident, also withdrew his complaint while the case was in the appeal stage. Therefore, it was decided to change the qualification of the crime attributed to the defendant Fatma Zehra Kınık to 'causing the death of a person by negligence,' and the 4 years and 2 months prison sentence was overturned. The appeal court sent the case back to the local court for re-examination.
