In a dramatic incident on the New York subway, a 69-year-old homeless man killed one of a group of bullies who tried to steal his belongings and attacked him, and injured another. The Queens District Attorney's Office stated that the man acted in self-defense and announced that no charges would be filed. The incident occurred on the night of December 22 on the 7 train line. Security camera footage shows the elderly man sleeping in the car while his bags were being stolen by two individuals named Stalin Moya and Oswaldo Walter. The man, who followed the attackers to retrieve his belongings, was assaulted by the group in the second car. Continuously punched and pushed, the man eventually pulled out a knife to defend himself. Queens District Attorney Melinda Katz stated, "The victim was attacked for no reason, and our investigation shows that he was merely defending himself while trying to get his belongings back." Moya lost his life in the incident, while Phillipe Pena was injured. The surviving attackers Pena (26), Walter (29), Jose Valencia (35), and Henry Toapanta (32) were arrested for robbery and assault. The prosecution noted that all suspects were also homeless. The incident has once again brought attention to the rising violence in the New York subway. In two similar incidents last year, passengers who defended themselves were found not guilty. Prosecutor Katz emphasized the importance of subway safety, stating, "Our subways must be safe for millions of people who rely on public transportation."
