DETAILS OF THE INDICTMENT HAVE BEEN REVEALED



Details of the indictment prepared as a result of the investigation initiated regarding the statements made by Turkish Industrialists and Businessmen Association (TÜSİAD) Board Chairman Orhan Turan and High Advisory Council (YİK) President Mehmet Ömer Arif Aras during the association's general assembly have been revealed.



In the indictment prepared by the Istanbul Chief Public Prosecutor's Office, it was stated that the suspects Aras and Turan claimed that there was no legal security throughout Turkey, that citizens had a trust problem towards the Republic of Turkey, and that there was unrest due to this, asserting that the processes of arrest were unlawful, and that legal measures such as the appointment of trustees, detention, and arrest undermined public trust. The indictment noted that the suspects disseminated misleading and disinformation content by making evaluations regarding political, legal, judicial, and administrative events of which they were unaware.



"THEY EXPANDED THE SCOPE OF THE ACTION WITH THEIR POSITION AND CAREERS"



The indictment stated that Aras's speech was published in video and written form on TÜSİAD's website, and that the suspects expanded the scope of their action by taking advantage of the ease provided by their positions and careers in the field of economics and their presence in the presidency of an association with many members.



It was noted in the indictment that the statements of the suspects exceeded the limits of freedom of thought and opinion (expression) and could not be evaluated within the scope of the right to news or information. It was also claimed that the suspects obstructed the public's right to receive and access accurate news or information through misleading information, and that they made statements regarding events and judicial matters that concerned the general public solely to create anxiety and panic among the public.



"SUITABLE FOR DISRUPTING PUBLIC PEACE"



The indictment emphasized that the words of the suspects were related to the country's internal and external security, public order, and general health, and that their actions were suitable for disrupting public peace. It was highlighted that the suspects provided false or misleading information to manipulate the public on political, economic, and commercial issues. The indictment requested that the suspects be punished for the crime of "publicly disseminating misleading information through the press and media in a chain-like manner," while noting that the investigation file regarding the crime of "attempting to influence a fair trial" was separated. It was stated that the separation decision was made due to the different investigation procedures and the elements harmed by the crime. The indictment was sent to the Istanbul 28th Criminal Court of First Instance.
