A mother living in Muğla, Nazlı Zeynep A., was sentenced to 3 days of 'coercive imprisonment' for bringing her 7-year-old daughter, for whom she has temporary custody, to her estranged husband 43 minutes late during their divorce proceedings.

In the Fethiye district of Muğla, Nazlı Zeynep A. (48) had her appeal against the 3-day 'coercive imprisonment' decision rejected, which was given for taking her 7-year-old daughter S.D.A. 43 minutes late to the place where she was supposed to meet her estranged husband B.C.A., with whom she has been in a divorce case for 4 years. After leaving her daughter with her lawyer, Nazlı Zeynep A. was taken to prison by the gendarmerie.

Nazlı Zeynep A. and B.C.A. separated in 2021 and filed for divorce mutually. While the divorce case was ongoing, the court granted temporary custody of their child S.D.A. first to mother Nazlı Zeynep A. and then to father B.C.A. The Fethiye 1st Family Court, most recently on February 6, granted temporary custody of S.D.A. to her mother, while ruling that father B.C.A. could see his daughter twice a month under the supervision of social services and law enforcement officers. On the second day of Ramadan, when Nazlı Zeynep A. took her daughter to the meeting place determined by the Fethiye Judicial Support and Victim Services Directorate, she found that the father was not there. Nazlı Zeynep A. learned that B.C.A. had filed a report claiming that his daughter was not brought by her mother at the scheduled visitation time.

APPEAL AGAINST THE COURT'S DECISION

The Fethiye 1st Family Court decided to impose a 3-day coercive imprisonment on Nazlı Zeynep A. on the grounds that she did not comply with the proper notification to have the child ready at the requested place and time by the Fethiye Judicial Support and Victim Services Directorate. The decision stated, "It was decided to punish the defendant party, who acted contrary to the interim decision regarding child custody and the custody arrangement, with 3 days of imprisonment."

Nazlı Zeynep A. claimed that she normally delivered her daughter at 09:00 on visitation days, but on that day, the official who called from the Fethiye Judicial Support and Victim Services Directorate informed her that the visitation time was 10:00, and she appealed the decision through her lawyer Meltem Banko. In the lawyer's appeal, it was emphasized that no concrete and clear accusation of violation of obligation was made by the client, and that merely a formal deficiency would not be sufficient to decide on a measure restricting freedom based on the violation of obligation; it was necessary to present strong, clear, and convincing evidence that the client had the intent to act contrary to the court's decision.
