In the retrial of the mother who drowned her daughter in Izmir, she said, "Drugs pulled the strings of our home. My daughter was a completely different person before drugs. My heart is burning." The Court of Cassation overturned the 18 years and 4 months prison sentence given to the mother. The panel reduced her sentence to 16 years and 8 months on the grounds that the defendant acted under provocation and due to her good behavior during the hearings.
In the decision hearing of the case seen in 2022 at the 23rd Heavy Penal Court of İzmir, the court panel sentenced Ayşe Vural to aggravated life imprisonment for the crime of "intentional killing of a descendant." The panel noted that Zeynep exhibited aggressive behavior towards family members and physically assaulted them due to her psychological disorder and addiction, and also applied "provocation" and "good behavior" reductions. Thus, Vural's sentence was reduced to 18 years and 4 months in prison. The defendants who were tried without detention were acquitted. The decision was also upheld in the appellate court.
THE SUPREME COURT OVERTURNED THE SENTENCE
After the appeal, the 1st Criminal Chamber of the Supreme Court, which examined the file, concluded that the defendant Ayşe Vural committed the act in question under provocation. The Chamber decided that the first-instance court imposed an excessive sentence on the defendant considering the nature and extent of the acts that constituted unjust provocation, and overturned the decision of the first-instance court regarding Ayşe Vural. The Chamber upheld the acquittal decision regarding S.V. and Ö.V.
"DRUGS PULLED THE STRING OF OUR HOME"
Following the overturning decision, Vural appeared before the judge again today at the 23rd Heavy Penal Court of İzmir. Ayşe Vural connected to the hearing via SEGBİS, while the lawyers were present in the courtroom. During the hearing, the defendant Vural stated, "There are defendants in prison for drug trafficking. I can’t breathe due to being in the same environment as them. May lightning never strike any home as it struck ours. I can't even hurt an ant. I am not that kind of person at all. Drugs pulled the string of our home. My daughter was a completely different person before drugs. My heart is burning. Every time I see drug dealers in prison, I die a little more. No decision can end the pain inside me, but at least I want to breathe," she said.
"THE DEFENDANT WHO EXPERIENCED THE GREATEST DISASTER"
Ayşe Vural's lawyer, Mehmet Ali Orman, who spoke during the hearing, stated, "My client is not someone who constantly commits crimes or is prone to committing them. We request that the maximum unjust provocation reduction be applied in the sentence against my client. The defendant is the one who has experienced the greatest disaster."
SENTENCE REDUCED TO 16 YEARS AND 8 MONTHS
After the defenses, the decision was announced. The panel sentenced the defendant Vural to 20 years in prison for the crime of 'Intentional Killing.' Due to the fact that the defendant committed the act under provocation and her good behavior during the hearings, the panel reduced the sentence to 16 years and 8 months in prison.
