Ekrem Dur, who is on trial for allegedly breaking Deniz Eroğlu's nose with a punch while his children were with him on the Marmaray, was sentenced to 1 year and 5 days in prison for "intentional injury under provocation" at the first hearing.
"I TOLD HIM 'YOU MADE THE CHILD CRY', HE SAID 'HE DESERVED IT'"
At the first hearing at the Anadolu 85th Criminal Court of First Instance, the defendant Ekrem Dur, the complainant Deniz Eroğlu, and the lawyers of both parties attended. In his defense, the defendant Ekrem Dur stated that he boarded the Marmaray to go home on the day of the incident, saying, "Mr. Deniz was boarding the Marmaray near Bostancı, and a girl named Zehra was standing by the door. Although she boarded without tripping, I said, 'Why are you standing here, we will trip over you,' and the girl still said, 'I'm sorry, brother.' She continued to shout loudly right behind me."
Dur noted that when he approached the door to get off, he saw the girl crying heavily, stating, "Mr. Deniz was right next to me. I calmly said, 'Brother, you upset the child, you made her cry. What you did is not nice.' He shouted back, 'He deserved this, I did less than he deserved. What do you care, who are you to interfere, I can say whatever I want.' I replied, 'We are all standing at the door, the Marmaray is crowded, this is not a crime.' Then he said, 'Don't prolong it, mind your own business, shut up. Get off, let's talk there.' Then he started threatening me inside."
"I HIT UNINTENTIONALLY"
The defendant stated that he hit the complainant unintentionally, thinking they would fight, and expressed that he apologized to the complainant and regretted that such an incident occurred.
The complainant Deniz Eroğlu explained that the defendant punched him and fled, and that he started bleeding because his nose was broken, stating that the accusations hurt him more than the punch itself.
HE WAS SENTENCED TO 1 YEAR AND 5 DAYS IN PRISON
The judge announced the decision, sentencing the defendant Ekrem Dur to 1 year and 5 days in prison for "intentional injury under provocation."
The court, which decided to suspend the announcement of the verdict, ruled that the defendant would be subject to supervision for 5 years.
FROM THE INDICTMENT
On May 31, the Anadolu Chief Public Prosecutor's Office completed the investigation regarding the incident where Deniz Eroğlu, who was traveling with his two children on the Marmaray, was punched during an argument with a woman over giving up a seat, and prepared an indictment.
The indictment stated that on the day of the incident, the complainant Eroğlu boarded the Marmaray with his two children, and that the defendant Ekrem Dur and I.A., who was decided not to prosecute, were passengers in the same carriage. It was noted that a verbal argument started between the complainant and the witness Zehra A., who was standing at the boarding door, due to their position in front of the door.
It was recorded that when Zehra A. cried during the argument, the defendant Ekrem Dur told the complainant, "You yelled at the lady, she is crying. It was not right to shout like that in front of everyone, you could have warned her properly."
Subsequently, it was stated in the indictment that I.A. also became involved in the verbal argument, and that the defendant called the complainant outside to fight, while the complainant did not get off the train due to having his children with him. It was explained that the suspect pulled the complainant outside the train and punched him in the face, and that an investigation was initiated after the complainant filed a complaint.
The indictment mentioned that the defendant Ekrem Dur stated that he argued with the complainant after shouting at Zehra A., and that the complainant insulted him, and that he punched the complainant in that moment of tension.
The report from the Forensic Medicine Institute stated that the complainant Deniz Eroğlu was injured in a way that could not be resolved with simple medical intervention and that it caused a bone fracture.
A prison sentence of 1 year and 6 months to 4 years and 6 months was requested for the defendant Ekrem Dur for "intentional injury."
Additionally, a separate investigation was initiated by the Anadolu Chief Public Prosecutor's Office against Deniz Eroğlu after Zehra A. claimed that he insulted her and filed a complaint against the father who punched her.
