According to the allegations, E.Z.I. was subjected to sexual abuse by 3 suspects inside the truck and was dropped off in the Körfez district 4 days later. Following the revelation of the incident, truck driver Mahmut C., Orhan D., and Ümit K. were taken into custody. Mahmut C. was arrested and sent to prison. Medical examinations confirmed that E.Z.I. had been sexually abused.
37 YEARS 9 MONTHS PRISON SENTENCE WAS OVERTURNED
In the hearing held on April 11, 2023, by the Kocaeli 1st Heavy Penal Court regarding the incident, Mahmut C. was sentenced to 22 years and 6 months for the crime of "qualified sexual abuse of a child," 6 years for "deprivation of liberty," 3 years for "illegally disclosing images and sounds related to private life," and 6 years and 3 months for "encouraging a child to prostitution." Orhan D. and Ümit K. were each given 3 years in prison for the crime of "engaging in sexual intercourse with a minor." The sentence given for determining the real age of the victim E.Z.I. was overturned by the Sakarya Regional Court of Appeals 7th Criminal Chamber upon the objection of the defendants' lawyers.
"SHE MISLED US BY GIVING THE WRONG AGE"
The 5th session of the retrial was held at the Kocaeli 1st Heavy Penal Court. While the unarrested defendant Orhan D. and the lawyers of the parties were present in the courtroom, Mahmut C. participated in the hearing via SEGBİS from the prison where he was held. The unarrested defendant Orhan D. requested his acquittal.
In his defense, Mahmut C. stated, "E.Z.I. misled us by giving the wrong age. Nevertheless, I did not have any sexual relations with her. I did not force her in any way. I request that this matter be taken into consideration when making a decision about me. I have no dealings with E.Z.I. She is not telling the truth, and I have regrets," he said.
HE WAS SENTENCED TO 34 YEARS 7 MONTHS IN PRISON
The court panel sentenced Mahmut C. to 22 years and 6 months for the crime of "qualified sexual abuse of a child," 6 years for "deprivation of liberty," 3 years for "illegally disclosing images and sounds related to private life," and 3 years, 1 month, and 15 days in prison along with a fine of 6,000 TL.
2 DEFENDANTS WERE ACQUITTED
The unarrested defendants Orhan D. and Ümit T. were acquitted on the grounds that the elements of the crime were not present in the act.
