In the indictment, while no charges were brought against Vesile Bingöl's husband, İsmet Bingöl, for 'intentional killing', a prison sentence of 4 to 10 years for 'incitement to suicide' and 3 to 8 years for 'cruelty against a spouse' was requested. Furthermore, it was stated in the indictment that no concrete reason was found regarding the death of İsmet Bingöl's first wife, and a verdict of acquittal was given.
TRIAL CONTINUED
The trial of the defendant, İsmet Bingöl, who is not in custody, continued. In the hearing held at the Bakırköy 4th High Criminal Court, the defendant, İsmet Bingöl, was present via the SEGBİS system. The family of the deceased, Vesile Bingöl, also attended the hearing.
"VESİLE ALWAYS SAID 'İSMET WILL KILL ME'"
In her testimony, witness Perisiman Bingöl stated, "Vesile is my stepdaughter. Her biological mother is different, but she is registered under my name. One day, İsmet took Vesile to the bathroom and shaved her hair with a machine. He shaved Vesile's hair to zero. Vesile always said, 'İsmet will kill me.' I am a complainant," she said.
"HE WAS TORTURING MY DAUGHTER"
Witness Gülistan Karabay said, "Vesile is my biological daughter. He was always beating her. He was torturing my daughter. They were fighting. He was jealous of her. One day, Vesile came to me and said, 'İsmet took my head and hit it against the wall.' Even when he went to the market, he was following her. My daughter never looked at anyone with a side glance. İsmet would lock the door and leave the house. He didn't even bring food home," she stated.
"SHE HAD SACRIFICED HERSELF SO HER FAMILY WOULD NOT BE HARMED"
Vesile Bingöl's cousin, witness Şükran Bingöl, said, "We could understand the difficulties Vesile was experiencing. Vesile used to be very cheerful. One day, she told me that İsmet had beaten her. He hit her head against the wall. I told her to tell her family. But Vesile said to me, 'Don't tell my family, it will harm them too.' She had sacrificed herself so her family would not be harmed. We could not reach Vesile because İsmet broke the phones," she expressed.
DID NOT ACCEPT
The defendant, İsmet Bingöl, stated that he did not accept the witness statements. The court postponed the hearing to address the deficiencies.
FROM THE INDICTMENT
In the indictment prepared by the Bakırköy Chief Public Prosecutor's Office, it was stated that on July 24, 2023, a report of suicide was received by the law enforcement units in Bakırköy, and the police went to the scene. It was also recorded in the indictment that the deceased, Vesile Bingöl, was loaded into the ambulance dead. In the indictment, Şaban A., who lived in the same apartment as his sister Vesile Bingöl, stated, "On the day of the incident, İsmet Bingöl shouted, 'Şaban, run, run.' My brother was lying on the ground. The television was very loud. İsmet Bingöl was fully dressed; he was not in a home state. İsmet Bingöl went to prison for killing his first wife. He would sometimes apply violence to Vesile," he said. The indictment also detailed the judicial process regarding the death of İsmet Bingöl's first wife. It was stated in the indictment that "İsmet Bingöl argued with his deceased first wife when he woke up in the morning, just like in this incident, and that his wife committed suicide by moving to another room, just like in this incident. He also had a nervous breakdown when he saw his wife and called out to his relatives, and just like in this incident, no concrete reason was found for the deceased's suicide, and a verdict of acquittal was given for İsmet Bingöl." Furthermore, it was noted that during the examinations conducted at the house, the knot of the rope from which Vesile Bingöl hanged herself was loose, and that the knots should have tightened in the event of hanging. The report prepared by the Forensic Medicine Institution stated that there was no medical evidence that Vesile Bingöl died other than hanging. The indictment stated that there was an allegation that Vesile Bingöl did not hang herself but that her husband staged the incident as a suicide, and it was noted that "However, ultimately, it was revealed in the scientific and uncontradicted report of the Forensic Medicine Institution and the expert report that it was a 'hanging suicide' of the deceased." The public prosecutor stated that no concrete evidence was found that İsmet Bingöl killed his second wife after his first wife and that it was necessary to accept that Vesile Bingöl, his second wife, committed suicide. For this reason, a decision was made not to prosecute İsmet Bingöl for 'intentional killing'. The indictment stated that İsmet Bingöl engaged in humiliating actions against his wife, applied physical and psychological violence, and that under the influence of drug use, he fundamentally disrupted Vesile Bingöl's life and did not allow her to go outside. The public prosecutor stated that it was claimed that İsmet Bingöl's first wife also committed suicide, indicating that his aim was to drive Vesile Bingöl to suicide, just like he did with his first wife. The prosecutor also stated that Vesile Bingöl was subjected to accusations of infidelity without any reason, stating that "İsmet Bingöl wanted his wife to die and led her to this mental state, and through his systematic actions involving torture, he also directed her towards suicide." While no charges were brought against İsmet Bingöl for 'intentional killing', a prison sentence of 4 to 10 years for 'incitement to suicide' and 3 to 8 years for 'cruelty against a spouse' was requested.
