Sevilay Kıral (30), who is being tried in detention for allegedly murdering Mustafa Kurt together with her boyfriend Tahir Güray Çakmak in Zonguldak, has been reported to have full criminal responsibility in the awaited mental health report. Meanwhile, F.B. (37), who is also in prison for another crime, proposed marriage to Kıral by letter and stated that he would present audio and video recordings of the events that took place between Kurt and Çakmak to the court regarding the murder.

On February 23, 2023, an incident occurred in the house on Mustafa Aşçı Street in the Karaelmas neighborhood of Zonguldak; Mustafa Kurt, a father of four working at the Turkish Hard Coal Enterprise (TTK), went to the house of his 11-year colleague Sevilay Kıral, with whom he had a feud over a debt, who also worked at the same institution and lived in a separate TTK-owned lodge. According to allegations, a dispute broke out between Kurt, Kıral, and Kıral's boyfriend, Tahir Güray Çakmak, at the house. As the argument escalated, Kurt was stabbed in the leg and back. Attempting to escape outside to call for help, Mustafa Kurt collapsed to the ground in a pool of blood. Kurt, who was taken to the hospital by the arriving medical teams, lost his life. Following the incident, Sevilay Kıral and her boyfriend Güray Çakmak, who were taken into custody, were arrested.
In the indictment prepared by the Chief Public Prosecutor's Office, it was stated that the couple planned the murder before it occurred, that Kıral committed the murder, and that Çakmak participated in the crime, leading to a case being opened against them for 'Intentional Murder with Premeditation' with a request for aggravated life imprisonment. During the trial at the Zonguldak 1st Heavy Criminal Court, one of the defendants, Tahir Güray Çakmak, was released at the first hearing.
REPORT ON THE DEFENDANT'S FULL CRIMINAL CAPACITY HAS ARRIVED
During the 6th hearing of the case, while the lawyers of the parties were present in the courtroom, Sevilay Kıral was connected via SEGBİS. The mental health report from the Forensic Medicine Institution, which had been awaited for three hearings, reached the court. According to the report, it was determined that Kıral had full criminal capacity at the time of the incident. Kıral's lawyer stated, "My client says she was using medication along with alcohol at the time of the incident. We requested an examination regarding whether she had the physical strength to commit this act while under the influence of the medication and alcohol she used on the day of the incident. The report lacks this aspect. It has only been prepared regarding her mental state, without considering whether she had the strength to inflict the injuries on the deceased. We request that it be arranged accordingly."
PROPOSED MARRIAGE BY LETTER IN PRISON
During the hearing, F.B., who was detained for another crime, was heard as a witness. Letters in which F.B. proposed marriage to Kıral while in prison were presented to the court. In the letters, F.B. stated, "I would do anything for you, I loved you without being side by side, will you marry me?" F.B. explained that he met Sevilay Kıral and Tahir Güray Çakmak about 3-4 months before Mustafa Kurt was killed, saying, "Mustafa brother had told me that Güray was obsessed with Sevilay. I found Güray and picked him up in my car. We went to Gelik Ayiçi neighborhood. At that time, I didn't know Sevilay well; I only knew her because of Mustafa. While we were driving, I asked Güray what he was doing with Sevilay. He said to me, 'Who sent you to me?' So, I beat Güray. I have a video belonging to Güray. I will deliver this video to the court. When you watch it, everything will be revealed."
"I TOLD YOU PART OF THE VIDEO, YOU WILL SEE IT WHEN IT REACHES YOU"
When the judge asked the witness about the content of the video, the witness replied, "The video I have is related to Güray and Mustafa. I told you part of the video. You will see the remaining part when it reaches you." When pressed repeatedly about the content of the video, he responded, "You will see it when it reaches you; I don't want to talk more."
The court panel gave the witness time to deliver the video by the next session. The request of Kıral's lawyer for a new report regarding whether the deceased had the strength to inflict the injuries was rejected. The hearing was adjourned, giving the prosecutor time to present his opinion.
