Details are beginning to clarify regarding the 12th Judicial Package, which the AK Party is working on and is expected to be submitted to Parliament. According to the draft; public officials who receive sentences of up to two years for crimes such as mistreating citizens will no longer be able to benefit from the deferral of the announcement of the verdict and will not be able to postpone their sentences.
The details of the 12th Judicial Package, which AK Party officials are working on and expected to be submitted to Parliament, include regulations on important issues affecting many segments of society. The AK Party plans to simplify the draft package, which totals 60 articles, by leaving articles that could spark debate during discussions to subsequent packages. For this reason, it has been stated that the number of articles will be around 25, and if work on it is completed next week, it will be submitted to the Parliament Speaker's Office.
WHAT IS IN THE PACKAGE?
According to the report by Haberler.com Ankara Representative Şerife Güzel; one of the regulations in the package concerns public personnel who mistreat citizens. In the current situation, public personnel who engage in mistreatment benefit from the 'postponement of the pronouncement of the judgment' provision in Article 231 of the Criminal Procedure Code, which applies to sentences up to 2 years, and their sentences are deferred under a 5-year probation condition. However, the Constitutional Court annulled this article of the law on July 10, 2025, and gave Parliament 9 months to make a new regulation.
BAD NEWS FOR OFFICIALS WHO MISTREAT
AK Party lawyers are working on the 12th Judicial Package, which includes a regulation regarding the Constitutional Court's annulment decision. In the preparation, it is envisaged that sentences up to 2 years imposed on public personnel for crimes such as mistreatment will be excluded from the scope of the postponement of the pronouncement of the judgment. If this regulation passes through Parliament, for example, a police officer who mistreats a citizen coming to the police station and is taken to court, if convicted, will have to serve the sentence. They will not be able to benefit from the possibility of postponement of the pronouncement of the judgment.
HEARINGS WILL BE SCHEDULED AT MOST 3 MONTHS APART
The 12th Judicial Package will also include an important regulation to speed up trials. Except for special circumstances that may take a long time, such as requesting documents from abroad, the package includes an article stipulating that hearings should be held at intervals of no more than 3 months.
REGULATION FOR DISPUTED INHERITANCE SHARES
Another regulation in the 12th Judicial Package addresses the sale for the dissolution of co-ownership, traditionally known as izale-i şüyu. This sales method applies when property owned jointly through inheritance or other means cannot be shared, and any shareholder can file a lawsuit to demand the division of the property.
In the current situation, an auction for a property put up for sale through the dissolution of co-ownership (Izale-i şüyu) is conducted openly online. For example, someone from Edirne could enter the auction and buy a house in a village in Kars. It is noted that this situation creates problems for relatives living in that village, and there have been intense complaints about this matter. AK Party officials are including a regulation in the 12th Judicial Package so that the first auction for a property put up for sale through the dissolution of co-ownership will be open only to the heirs, in order to address such public complaints. If none of the heirs purchases the property in the first auction, the second auction will be open to everyone.
Additionally, under the current system, heirs participating in the auction do not pay a deposit for the auction price; from now on, heirs will also be able to participate in the auction by paying a deposit.
A CHECK ON THE SALE OF ELDERLY PEOPLE'S PROPERTY
The package will also include a regulation regarding the sale of property belonging to individuals under guardianship. The auction method, which allows a few pre-planned individuals to enter the auction and share the property of lonely elderly people, will be abolished. From now on, the sale of property belonging to individuals under guardianship will also be conducted openly online.
