In the trial of the case where Savaş Temirhanoğulları, who was in the process of getting divorced, killed Fadim Temirhanoğulları with 9 bullets last year in Antalya, the witness's statements caused a stir in the court. The witness's words, "I saw a man leaving the house at night 15 days before the incident," were met with a strong reaction from Fadim's family.

The manager of Atapark Housing Site in Hurma Neighborhood of Konyaaltı district, Fadim Temirhanoğulları, who had obtained a 3-month restraining order against her estranged husband Savaş Temirhanoğulları, came home around 05:00 on September 12, 2024. Savaş Temirhanoğulları shot his wife with a gun and fled. At that moment, their daughter I.T. (16), who was sleeping in her room, woke up to the sound of gunfire, thought she was having a nightmare, and went back to sleep. The high school student I.T. woke up around 08:30 with a phone call from a school friend.

SHE SAW HER MOTHER IN A POOL OF BLOOD

When I.T. came out of her room and saw her mother in a pool of blood, she ran out of the house and knocked on the door of the neighbor across the street. The neighbors who came to the house notified the 112 Emergency Call Center. The health teams dispatched to the address determined that Temirhanoğulları had lost her life. The police launched an operation to capture Savaş Temirhanoğulları, who was identified as working as a security guard at an entertainment center in Kemer district.

CAPTURED IN KORKUTELİ

Teams from the homicide bureau, examining security camera footage, determined that Savaş Temirhanoğulları had gone to Korkuteli district in the vehicle of his friend Fikret İnal. The teams captured Temirhanoğulları and İnal at the place where they were hiding, along with the weapon used in the crime. Savaş Temirhanoğulları and his friend Fikret İnal, who was alleged to have assisted him in escaping, were arrested.

REQUEST FOR PUNISHMENT FOR ARMED THREAT AND INSULT

Temirhanoğulları is being tried for 'premeditated murder of a spouse', while İnal is charged with 'aiding and abetting the premeditated murder of a spouse'. The 6th hearing of the case was held at the 1st Heavy Penal Court. The case regarding 'premeditated murder of a spouse' was combined with the case opened at the 26th Criminal Court of First Instance after Fadim Temirhanoğulları filed a complaint against Savaş Temirhanoğulları for armed threat and insult last July. The prosecutor, who presented the opinion regarding the combined case file, requested that the defendant Temirhanoğulları also be punished for armed threat and insult.

DEFENDANT: I DON'T REMEMBER THE MOMENT OF THE INCIDENT

Savaş Temirhanoğulları, when asked about the expert report stating that the victim was killed by a bullet from a gun evaluated as 'long-range shooting', said, "I don't remember the moment of the incident. I faced the police at the moment of my capture. I handed over the gun myself." Fikret İnal stated that he was caught in the middle during the sudden incident and that he was innocent.

NEW CLAIM FROM THE WITNESS NEIGHBOR

The defendant's lawyers requested that Ümit Ertürk, the neighbor of the victim who claimed that another man had exited the house 15 days before the incident, be heard as a witness. Witness Ertürk said, "I thought the gunshots were coming from outside. If I had realized they were coming from my neighbor's house, I would have intervened. I looked outside, and when I didn't see anything, I went back to bed. I had no knowledge about the divorce process. I learned about the incident when my wife heard the screams; I was at work. I saw a man leaving the house at night 15 days before the incident. He was someone I didn't know," he said.

MOTHER CRIED OUT IN TEARS

The witness's lawyers stated that they would file a complaint against Ertürk for false testimony due to contradictory statements in the file. The victim's sister, Canan Ateş, claimed that the defendants and Ertürk made false statements to receive a reduced sentence and demanded the heaviest punishment for the two defendants. The mother, Mediha Saçlı, cried, "They found a false witness. My child was brutally killed with 9 bullets. They took my child's life."

During the hearing, a dispute occurred between the relatives of the defendants and witnesses in the courthouse corridor. The police intervened to prevent the scuffle and removed both groups from the courthouse. The court decided to continue the detention of the two defendants, and the hearing was postponed to October 15.

REACTION TO THE NEW WITNESS

After the hearing, Lawyer Yağmur Burçin Sayın, speaking on behalf of the Association for Children and Women First, stated, "We do not believe that the new witness will change the essence of the case. The victim Fadim's honor was insulted. We want these cases not to be prolonged to stop femicides. Femicide is above politics. We are here as all women's communities. We stand by Fadim's family. A life sentence with aggravated intent against women was requested. We have no objection to the prosecutor's opinion."

The victim's mother, Mediha Saçlı, stated that she wanted the perpetrators who brutally killed her daughter to receive the heaviest punishment. Saçlı, who claimed that the new witness was giving false testimony, said, "A man came out from inside. There is a child at home. I hope they get their punishment," expressing her reaction.
