The trial of Hikmet Şaban, who shot and killed Hasan Hüseyin Osmanoğlu with a gun during a dispute in a park in the Kartepe district of Kocaeli, has begun. In the hearing, Şaban stated that Osmanoğlu was communicating with his wife on social media and said, "I have children too. I didn't want to leave anyone's child an orphan. I had no intention to kill."

On the night of March 29, in the Derbent neighborhood of Kartepe district in Kocaeli, the first hearing was held in the murder case where 34-year-old Hasan Hüseyin Osmanoğlu lost his life as a result of an armed fight in the park. The hearing at the Kocaeli 4th Heavy Penal Court was attended by the detained defendant Hikmet Ş., the defendants Adem A. and Ertuğrul Ç. who are being tried without detention, as well as the lawyers of the parties, the victim's family, and witnesses.

THE DISPUTE IN THE PARK ENDED IN BLOOD

The incident occurred on the evening of March 29 in the park on Ahmet Lütfü Arat Boulevard in the Derbent neighborhood. Hasan Hüseyin Osmanoğlu met Hikmet Şaban in the park. During the argument that broke out there, Şaban fired three shots at Osmanoğlu with the gun he was carrying. Osmanoğlu, who was hit in the chest by the bullets, died in the hospital to which he was taken. The funeral of Osmanoğlu, who was married and a father of three and was known to work as a baker in the district, was buried in his hometown of Trabzon. The murder suspect Şaban and A.A. and E.Ç., who are believed to have assisted in his hiding, were detained by the police. After the procedures at the police station, the suspects were sent to the Kocaeli Courthouse, where Şaban was arrested while A.A. and E.Ç. were released under judicial control.

INDICTMENT PREPARED

In the indictment prepared by the Public Prosecutor regarding the incident, it was requested that Hikmet Şaban be sentenced to aggravated life imprisonment for the crime of 'premeditated murder' of Hasan Hüseyin Osmanoğlu, while the defendants A.A. and E.Ç. be sentenced to imprisonment of 6 months to 5 years for the crime of 'aiding a criminal.'

The first hearing of the case was held today at the Kocaeli 4th Heavy Penal Court. The detained defendant Hikmet Şaban, the defendants A.A. and E.Ç. who are being tried without detention, and the lawyers of the parties attended the hearing. Şaban, who was given the floor, claimed that he had been in contact with Osmanoğlu's wife via social media, that Osmanoğlu had learned about this situation, and that at that time his wife was treating him and his children badly. He stated that on the day of the incident, he went to a gazebo after iftar and sat down, and after a while, Osmanoğlu and his brother H.İ.O. came to him and they started arguing. Şaban said, "As I tried to get up, H.İ.O. grabbed my arm and the gun fired three shots, then Osmanoğlu fell to the ground. We started to struggle with H.İ.O. We fell on top of Osmanoğlu. H.İ.O. cursed at me and ran away from the scene. I also ran away from the scene. I have children too. I did not want to leave anyone's child an orphan. I had no intention to kill. I request my release," he said.

After fleeing the scene, Hikmet Şaban stated that he met with the defendants A.A. and E.Ç. and that they left him at a shack. The defendant E.Ç. claimed that on the day of the incident, his father called him, but the person on the phone was not his father, and that he was called home, and when he went home, he saw Şaban. The defendant A.A. stated that he was at work on the day of the incident and that E.Ç. came and picked him up, and later dropped him back home. E.Ç. and A.A., who claimed they were unaware of the incident, requested their acquittal.

Witness H.İ.O. stated, "I went to the place where my brother was working upon his call. Hikmet Şaban was sitting in the gazebo across from the workplace. We went to him to talk. Şaban said, 'I will not talk, Hüseyin will talk.' I told my brother to stay away from Şaban. He sat across from him, and within a minute, he pointed the gun. I jumped on Şaban. We struggled a bit there, then he left. A total of three shots were fired. When I touched him, he had finished firing. Then I ran to the workplace to call for help," he said.

The court panel decided to continue Hikmet Şaban's detention and adjourned the hearing.
