An inspection was conducted as part of the compensation lawsuit filed at the 1st Consumer Court regarding the death of Adem Kaya and his daughters Açelya Mina and Alya Kaya, who were buried under rocks and soil that broke off due to the excitement of washing a car in the car wash section of a gas station in Samsun, and the injury of his wife Çiğdem Kaya. Çiğdem Kaya, shedding tears while looking at the landslide area, said, "They ruined my life, my family is gone. I lost my family due to negligence and irresponsibility. I do not forgive anyone for what they have done."
Çiğdem Kaya, who lost her husband and two daughters in a landslide at a gas station in Samsun, attended the site of the tragedy for the first time. During the inspection, Kaya, who experienced great pain, could not hold back her tears.
SHE HAD LOST HER HUSBAND AND 2 CHILDREN
The incident occurred on the evening of April 27, 2025, in the car wash section next to the gas station in the Devgeriş neighborhood of the Canik district. While Adem Kaya was washing his car with the license plate 34 K 5396, a landslide occurred on the adjacent slope. Adem Kaya, his wife Çiğdem Kaya, and their daughters Açelya Mina and Ayla Kaya were trapped under the falling rocks and soil. Many police, medical, fire, and AFAD teams were dispatched to the area upon the notification of nearby residents. Teams rescued Çiğdem Kaya, who had fractures in her arm, legs, and nose, as an injured person. Kaya was taken to the hospital for treatment. After 3 hours of work, the lifeless bodies of Adem Kaya and his 2 daughters were reached. Adem Kaya and his 2 daughters were buried in tears in the Karacalı neighborhood of the Terme district.
INDICTMENT AGAINST 2 DEFENDANTS
The Samsun Chief Public Prosecutor's Office assigned 1 Deputy Chief Public Prosecutor and 1 Public Prosecutor as part of the investigation. In this context, the owner of the gas station, Mehmet Zeki Gedikli (81), and the responsible manager K.Y. (62) were detained. Suspect Gedikli was arrested, while K.Y. was released under judicial control.
COMPENSATION LAWSUIT AGAINST BUSINESSES AND INSTITUTIONS
The indictment prepared by the Samsun Chief Public Prosecutor's Office was accepted by the 6th Heavy Penal Court. A prison sentence of 2 to 15 years was requested for K.Y. and Mehmet Zeki Gedikli for the crime of 'causing death and injury by negligence.'
In addition to the criminal case, the complainant party filed a compensation lawsuit against the business owner Mehmet Zeki Gedikli and the main company in the 1st Consumer Court, and against the Metropolitan Municipality, Canik Municipality, General Directorate of Highways Samsun Regional Directorate, and the State Water Works Samsun Regional Directorate in the 2nd Administrative Court.
FAULT RATES WILL BE DETERMINED
In the case opened today at the Samsun 1st Consumer Court, an inspection was conducted as a result of the decision taken. The court committee included a construction engineer, a geology engineer, a mapping engineer, and 2 expert witnesses in occupational safety. During the inspection, it was observed that mother Çiğdem Kaya shed tears while looking at the landslide area. It was stated that after the inspection, the fault rates of all institutions would be determined.
“IT IS EVIDENT THAT THERE ARE PROBLEMS IN TERMS OF ZONING”
After the inspection, the complainant's lawyer Kartal Akcan stated, "There was an inspection for the compensation case we opened at the Samsun 1st Consumer Court regarding the fatal incident that occurred here. The court committee included 2 occupational safety experts, a construction engineer, and a geology engineer. We filed this case against the local gas station owner and the main company. We pointed out to the court committee that this place is almost 90% sloped, very steep like a wall of a building. Unfortunately, the height of the rocks is between 10 and 15 meters. The biggest deficiency here is that the work called 'terracing' has not been done. To prevent the risk of large masses falling from harming the living beings or buildings below, a 5-meter-wide step is made every 4-5 meters. If there had been terracing, perhaps that family would still be alive today. There is a shopping center here. There was flood damage here in 2012. It is evident that there are problems in terms of zoning. We believe that both the gas station and the main company are at fault, as well as the municipalities."
“I CAME HERE FOR THE FIRST TIME AFTER THE INCIDENT”
Mother Çiğdem Kaya said, "I came here for the first time after the incident. It is so hard for me to stand and talk here. A catastrophe happened here on April 25. It was like hell. That fire entered my heart, and it doesn't go out. They ruined my life; my family is gone. I lost my family due to negligence and irresponsibility. I do not forgive anyone for my rights. They said, 'The shopping center will be closed,' but it was not closed. People are still shopping there. My 2 children died here. How can your conscience allow this? What happened to me today may happen to you tomorrow."
