The Ministry of Trade is preparing to expand the scope of renewed products to include televisions. With the new regulation, the status of devices such as mobile phones and tablets regarding loss, theft, and smuggling will be monitored in real-time, and it will be required for products to be listed on the "white list" available on e-Government in order to be renewed.
The Ministry of Trade will make regulations for the resale of televisions after renewing them, following mobile phones, tablets, smartwatches, computers, and game consoles.
The Ministry has submitted the draft regulation on Renewed Products to the relevant parties for their opinions. The regulation organizes the principles regarding the renewal and resale of mobile phones, tablets, smartwatches, computers, game consoles, and modems.
TELEVISIONS WILL ALSO BE RENEWED AND SOLD
According to the draft, televisions will also be included among the products that will be renewed and resold. Thus, it is aimed to contribute to the reliable reintegration of this product group into the economy and to prevent waste.
YÜBİS WILL BE MANDATORY
The Ministry will implement the Renewed Product Information System (YÜBİS) for these products. It will be mandatory for the renewal processes to be carried out through YÜBİS in accordance with the regulations determined by the Ministry, and for the electronic certificate created to be provided to consumers.
LOST-STOLEN AND STOLEN PRODUCT INQUIRIES WILL BE POSSIBLE
With the system, data obtained on issues such as authorized seller and on-site renewal point, authorization, lost-stolen and stolen product inquiries, data traffic control, validity status inquiries of the competency certificate and renewal authorization certificate will be tracked. Relevant sections of this data will be accessible and queryable by consumers. The system will ensure the completion and monitoring of certain stages of the renewal process and the certificate production processes.
There will be a requirement for renewal centers, authorized sellers, on-site renewal points, and other information and documents determined by the Ministry to be registered in YÜBİS.
Authorized centers will be required to have the Turkish promotional and user manuals prepared by the manufacturer or importer for the products they renew on their website. If requested by the consumer, the renewal center will provide this manual to the consumer in writing or via a permanent data storage device.
In cases where changes need to be made to the promotional and user manual of the product that has undergone renewal, the obligation to prove that the consumer has been informed of these changes will belong to the renewal center.
30 DAYS MUST PASS FOR SECOND RENEWAL
Sales made by authorized sellers with credit cards will need to be carried out through the virtual POS belonging to the renewal center.
At least 30 days must pass from the date of sale for a renewed product to be renewed again. This aims to prevent possible abuses.
WHITE LIST CONDITION
The draft also foresees regulations on the conditions required to obtain the renewal authorization certificate. Accordingly, it will be necessary to have a competency certificate obtained in accordance with the features specified in the regulations determined by the Ministry and to be a capital company.
A commission will be established by the Ministry to evaluate decisions regarding the warning of the renewal center, the suspension or cancellation of the authorization certificate as a result of inspections and examinations. It is anticipated that this commission will consist of 5 members.
For used goods with electronic identity information to be renewed, conditions such as being on the "white list" in e-Government and having data, voice, or short message usage traffic for at least one year will be sought.
The valuation process of the used goods must be completed within three business days following the date the goods are delivered to the renewal center, on-site renewal point, or authorized seller.
The payment for the goods and any promised benefits such as discounts or coupons must be provided on the day the consumer's approval of this valuation is obtained.
In contracts involving exchanges, these benefits will be provided on the day the consumer fulfills their obligations related to the transaction.
RIGHT OF WITHDRAWAL IS PLANNED
The draft expands the rights of consumers regarding renewed products.
To strengthen consumers' hands in the quality control of products released to the market, it is anticipated that the right of withdrawal granted to consumers in distance sales will also be extended to other sales methods.
Accordingly, in the sale of renewed products, the relevant regulatory provisions regarding contracts established through distance sales will apply. In contracts established through other methods, the consumer will have the right to withdraw from the contract without providing any reason and without paying a penalty within 14 days.
The draft regulation is planned to come into effect three months after its publication.
