A female teacher who filed for divorce from her unemployed husband will pay alimony.

A divorce case filed in Diyarbakır due to incompatibility ended with an interesting decision. The court ruled that both parties were equally at fault and sentenced the teacher, N.K., to pay a monthly alimony of 3,000 TL to his ex-spouse.

A mother of a child, N.K., who works as a teacher in Diyarbakır, married F.K. 16 years after her first marriage and after divorcing from her second husband, with whom she has two children. N.K. filed for divorce due to incompatibility. In her petition, N.K. stated that her husband did not take the marriage seriously and claimed that he did not care for the needs of the home and the children, also requesting material and moral compensation, as well as alimony for poverty.

DECIDED 2 YEARS LATER

F.K., on the other hand, argued in his petition that the events described were completely fabricated, claiming that his client fulfilled all the responsibilities imposed by the marriage, and requested material and moral compensation as well as alimony for poverty. The divorce case at the Diyarbakır 1st Family Court was concluded 2 years later. The court ruled that both parties were equally at fault for the events leading to the divorce and granted the divorce.

NOTABLE EXPRESSIONS IN THE REASONED DECISION

In the reasoned decision of the court, the following statements were included: "It has been understood that the plaintiff woman is at fault for the events leading to the divorce, as she married knowing that her husband had children from a previous marriage; after marrying, she did not accept these children, displayed hostile behavior towards them, and continuously insulted her husband and the children from his previous marriage, using abusive language and engaging in humiliating and degrading words and actions, and physically assaulted Burak, who was born from her husband's previous marriage. It is clear that the fundamental basis of the joint life has been shaken due to the behaviors of both parties, and it is no longer possible to continue the union. Both spouses are equally at fault for the behaviors that have shaken the foundation of the union. In this case, it is also not legally possible to force the spouses to live together. For the reasons stated, it was necessary to accept both the main divorce case and the counter divorce case and to decide on the divorce of the parties."

WILL PAY 3,000 TL ALIMONY MONTHLY

The court, taking into account the social and economic conditions of the parties reflected in the file, rejected the plaintiff woman's request for alimony for poverty, which did not meet the legal requirements, and decided that a monthly precautionary alimony of 3,000 TL would be taken from the defendant woman and given to the counter-plaintiff man, to continue until the decision becomes final, and after the decision becomes final, to continue as alimony for poverty, and ruled that the alimony determined would be increased each year by the rate of the Producer Price Index (ÜFE) following the finalization of the decision.
