In the lawsuit filed by her brother for the annulment of the will of Fatma Girik, one of the unforgettable names of Yeşilçam, the court ruled that Girik's will is legally valid.
Fatma Girik, one of the unforgettable names of Yeşilçam, passed away on January 24, 2022, in the hospital where she was receiving treatment and was buried next to her life partner Memduh Ün in Bodrum, Muğla, based on her will. In the will she prepared in 2018, Fatma Girik had divided her inheritance equally between her niece Fatma Ahu Turanlı and her sister Müyesser Girik.
SHE FILED A LAWSUIT CLAIMING SHE WAS NOT OF SOUND MIND
In her will, she also allocated certain amounts of financial shares to a total of 5 people, including her brother Günay Girik's two children, her foster family Ahu Aşkar, and the helpers working at home. However, the artist's brother, Günay Girik, filed a lawsuit for the "annulment of the will," claiming that his sister was not of sound mind at the time the will was prepared.
"SHE HAD LEGAL CAPACITY"
As part of the lawsuit process, the file was sent to the Istanbul Forensic Medicine Institution to determine Fatma Girik's mental health at the time she prepared her will. In the report prepared as a result of the examination conducted by the institution, it was stated that "it is deemed appropriate to accept that Fatma Girik had legal capacity on the date of the will, October 26, 2018," and it was noted that the decision was made unanimously.
COURT REJECTS THE CASE
On February 11, the 12th hearing held at the Bodrum 6th Civil Court of First Instance resulted in a decision. The court rejected Günay Girik's case and ruled that Fatma Girik's will is legally valid.
"THE ALLEGATIONS HAVE BEEN FOUND TO BE BASELESS"
Following the decision, Ahu Turanlı and Müyesser Girik's lawyers, Sabit Emekdar and Eylem Pektaş, made a written statement. The statement included the following expressions: "This issue is not a matter of inheritance dispute, but a matter of respect for a will. The court's decision is a legal confirmation of the late Fatma Girik's free will. The claim made by Günay Girik, that she was 'not of sound mind' for the sake of material gain, is an attempt to tarnish her precious memory, and it has been confirmed that these allegations are baseless."
The lawyers emphasized that the "inheritance crisis" news in the media does not reflect the truth, and that the process is solely about respecting Fatma Girik's will, stating that they reserve their legal rights against those who commit character assassination with unfounded allegations.
