The Ministry of Justice has decided that notaries will be on duty on Saturdays and Sundays with the new regulation, that the number of on-duty notaries will be determined based on the number of notaries in the province, and that the duty lists will be approved by the Union of Turkish Notaries and published online.
The Ministry of Justice has published a regulation that redefines the procedures and principles regarding the working hours and days of notaries. With the new regulation, notaries will be on duty on Saturdays and Sundays, provided that it does not coincide with official holidays. According to the regulation, transactions made by on-duty notaries will be assigned a daily number that continues from the day before the transaction date.
Notaries will only be able to perform urgent transactions that may cause damage if delayed, as well as the preparation and approval of wills, during holiday days and hours when on-duty services are not provided. In this case, it will be mandatory to state in the documents why the transaction was made on a holiday, and the transaction must be recorded under the daily number of the first business day following the holiday.
NUMBER OF ON-DUTY NOTARIES DETERMINED
With the regulation, the number of on-duty notaries has also been clarified. Accordingly:
- In provincial centers with at least 4 and at most 20 notaries, at least 1 notary will be on duty.
- In provincial centers with more than 20 notaries, at least 5% of the total number of notaries will provide on-duty services. The number after the decimal point will be rounded up in the calculation.
- Whether or not there will be on-duty notary services in districts and their numbers will be decided by the Ministry of Justice after consulting the notary chamber and the Union of Turkish Notaries.
DUTY LISTS WILL BE PUBLISHED ONLINE
- Duty lists will be prepared as primary and backup by the notary chambers.
- Lists will be submitted for approval to the Union of Turkish Notaries at least three weeks before the month in which they will be implemented. The Union will approve the lists within a week and publish them on its website.
- If the list is not sent in time, it will be prepared and published by the Union of Turkish Notaries. It will be mandatory to be on duty on the published duty days.
DUTY HOURS AND WORKING RULES
- Working hours for on-duty notaries will be between 09:00 and 17:00.
- 12:30-13:30 will be considered as lunch break, and no transactions will be accepted during these hours.
- Notaries managed by a proxy in cases specified in the law will also be included in the duty system.
- All transactions will be carried out in accordance with the relevant legal provisions.
